Hello i am new to the group but hoping someone can help. I have recently paid a high court enforcement, just to stop the visit, to do with bank smart. I have been in dispute with this company for many years and they have always threatened court action if i didnt pay what they said i owed. Bank smart is a con and i got conned. I disputed all with them directly by email as i couldnt ever get a phone number to speak to everyone. I even offer a payment of such to get them to go away. I didnt receive a court request letter and next thing i know i received a high court enforcement letter for over 3ooo thousand pounds. I dont have that kind of money to throw away but didnt want a visit either. I was told by the enforcement company to pay it and then appeal against it as i was still in dispute with bank smart. Since them no one has been able to advise me on how to appeal can anyone help? I had been trying to end bank smart for 7 years prior to this. They kept sending me letters and charging me when i asked them to stop and could never speak to anyone only email. Can anyone offer me advice i am losing sleep over this and causing me a great deal of stress ....

So you didn't receive court papers and only found out about the judgment when an enforcement officer visited you ?
Have you contacted the court to find out when this judgment was given ( in default ) - And why you didn't receive court papers ( wrong address maybe?) ? if not, do and ask for details of the claim. You will need to apply to set the judgment aside ( not appeal ) as you were not given opportunity to respond/defend.
presumably the £3k is made up of breach of contract and cancellation charges ? multiple accounts split to unfair charges / ppi etc....
any commission charges in there for successful claims they made ?

I am desperate for advise regarding this awful company. They wrote to me and my partner at the time I think it was around 2009/2010 stating that we were due a refund on our Lloyds account. As PPI claims were all over the media at the time we stupidly signed it thinking they knew something we weren’t aware of as we did bank with Lloyds at the time and had also had a car loan with them in the past. Within a few days we got a reply to our form asking for account numbers and whether the refund we were chasing was for a loan, credit card or mortgage. We realised they obviously didn’t have any idea so we promptly wrote back to them and told them to forget it. We then received a bill for £400 for their services (they hadn’t done anything)!! We ignored it and every few months we would receive a statement asking for £480 but £400 if paid within a week or so! My partner said no way are we paying that and we kept ignoring it thinking it’s a con. We then had a letter threatening us with court action and one that looked like a dodgey photo copied letter head from a debt company saying it had been passed onto them. Again it went back to random statements every now and then. Surely when a company excelates something it continues to court etc not back to statements which seemed odd. It’s been a few years now and I’ve now received another letter once again threatening court action. I’m no longer with my partner and I’m worrying like mad as I’m on my own with 2 young children and it’s making me ill. With Christmas coming up again I want this sorted once and for all as it’s constantly on my mind. How can a company who claim to help people regarding unfair PPI be allowed to rip innocent people off like this, they’re worse than the banks themselves. I’ve read they’re under investigation. Can anyone please help I’ve never had debt and I’m so stressed. Thanks in advance.

Thank you for getting back to me unfortunately I don’t have the original docs as it was so long ago but I’ll post the current letter. I’ve also realised they’re changed the date and are now saying it’s from December 2015 which is a lie as it was approximately 5 years before that when they originally wrote to us. What makes me so angry is that they contacted us it wasn’t like we went looking for advise. It’s so unfair and I never thought I’d get conned like this. Many thanks
