Bank Smart charges - please help!

My husband paid Bank Smart over £1000 in charges last year for supposed late fees and breach of contract, etc following a successful PPI claim that they pursued on his behalf, He is now constantly receiving further letters stating that he now owes more breach of contract fees and late payment charges for non-return of forms they say they have sent to him. These charges now equate to over £1500!!!!! We need advice please as to what we do and how we stop any further charges being incurred.

Oh goodness, Bank Smart are really ramping up the pressure on people recently, presumably in the run up to the deadline for claiming PPI I n August next year. We're seeing an increase in people struggling dealing with them.

Did he pay the commission charge from the successful PPI claim ? ( 25%+VAT )

Does he know the situation with the claims on the other accounts ?

Mostly they are just after returning of the letters of authority periodically ( though shouldn't be more than once each 6 months for each account ) - if he hasn't received those forms, he should ask them to resend them.

First of all you need to find out what the original instruction was and how it escalated to so many accounts. SOmetimes it's a blanket permission to go through the credit file and pick anything up.... which causes a flood of letters of authority to sign so they can put claims in..... so I

'd get him to send a Subject Access Request to them to get everything they hold and figure out exactly what the position is, ask specifically for the terms, any agreement, letters of authority, and any communications with third parties -> Subject Access Request Letter

Breach of Contract charges seem ( somehow) to be higher than their cancellation charges - not that I think either are particularly legitimate as we see them trying to claim Breach of Contract on cases that they'd already charged for cancellation on.
