  • HSBC Bank charges

    Hi everyone,

I was just wondering if anyone can advise fi I'm wasting my time trying to claim back my unauthorised overdraft fees from the last 4 years, they amount to over £3200, I have written to them for a refund due to hardship, I also referred it to the FOS but they have advised they
are unable to assist, would there be any point taking them to court or is it a waste of time and money?

Unfortunately you seem to have exhausted the options here. The Supreme Court judgment effectively legitimised bank charges and stops you from taking legal action for redress, and the regulators have failed to take alternative action to stop the exploitation also.

Sadly you won't get anywhere taking legal action for this.

Smithy, I am inclined to agree with Kafka, but wondered if you have read the county court judgment foster-Burrell v Lloyds, which could be a potential avenue, but would be highly dependant on you circumstances surrounding the imposition of charges.

On that subject, Radio 4 Your and Yours on Friday are doing a piece about the judgment.
