Re: How do i proceed? fuzzy v Abbey
I've not taken any action on this - I thought it was best let sleeping dogs lie. As it happens neither have Abbey or ther court, so as far as i am aware the claim is stayed.
Anyhow i get a letter from 1st Credit and I was in a stupid mood, so i rang them (hence the stupid mood). I informed them that the case was in court (3 times over in fact!!) I gave then all the relevant details - claim number etc.
Once i had done this the guy on the end of the phone demanded that i make full payment or they would take me to court!!
I told him is was already there so send it back to Abbey like a good like DCA! He just kept saying they were goign to court, so i hung up.
can they take me to court if its already there???? Surely they would have to apply to have the case unstayed and do a counter claim?????
