  • Discretionary car finance payment - will an IVA affect a claim?

    Hi All,

I have a friend (really!) who purchased a car that was through a regulated company, who had to enter an IVA after a couple of years to carry on paying for the car. As far as I'm aware, these would be treated as separate issues and the fact there is an IVA doesn't mean that she wasn't affected by the potential mis-selling, but have you another view? She's reticent to put a claim in due to being embarrassed by the IVA and I just want to assure her.

    Thanks!

The terms of the IVA could well be relevant. Subject to that I am not aware of any reason why an IVA should preclude bringing a mis-selling claim.

Thanks Atticus - I was thinking it would make things more relevant as it would have made the finance less affordable if commission was added on? I'll get her to check.

Clearly adding things like commission adds to the cost.
