  • BW Legal / The Money Shop Online - Letter of Claim help

    Hi there. sorry if its in the wrong place. I've tried posting in other sections but have had no reply.

    Last May I stupidly took out a payday loan with The Money Shop Online for £500. I had £500 being paid to myself for but I needed it for a certain date and was going to repay. However, circumstances changed and I never repaid the loan.

    Soon after I received a letter from BW Legals saying I owed them the money as they had bought the debt. I ignored it as I was behind on my rent as tax credits etc... were stopped. I still can't afford the full amount they are asking for as I'm now a single parent, on Income Support with a child on DLA. I also claim Carers Allowance.

    BW Legal are now asking for £748.53 by 31st July 2017, otherwise they will issue a claim against myself in the County Court without further notice. My circumstances at the time was I was living with the childs father who was working. He is no longer on the scene. My credit score was very poor at the time and I was surprised I was able to get a payday loan when I did. They have not sent me a letter this time, just an email.

    I have no idea how to respond to them. I've read various things online and been advised to post on here as you guys are the experts.

    Any advice would be greatly appreciated.

    Did the letter include a part saying they may "Consider" legal action?

      No it states

      We have been instructed by Instant Cash Loans Ltd to commence Legal Action and issue a Claim against you in the County Court in respect of the above debt.
      Legal Proceedings
      If payment or a response is not received before 31 July 2017, we will issue a Claim against you in the County Court without further notice. Such legal action may result in you being liable for court fees, solicitors' costs and statutory interest which are estimated below.

      It was emailed to me first and then in a letter.

        Ask yourself a question - Why are ICL not taking you to court themselves if it is fairly owing?
        They may start a claim but im pretty sure it might fall apart if defende properly.

          I had a loan out with the money shop and it was passed to bw legal eitber email them an income and expenditure and make them an offer that YOU can afford or register on their site and set up an affordable payment.I pay £5 a month..they are just trying to scare you

            I took out a loan with a time share company to improve the chance of better accommodation, the load was passed to a Consumer Lending Company at a very high interest rate, the fact that I wanted better accommodation did not work and the holiday complex closed down for the time share port folio. it was not made clear that I would be paying over 15 years at £46.17 with only £1.83 off the loan. I know it is not PPI so can I do anything about it?

              It might be better if you started a new thread of your own in the appropriate section
              Maybe a few more details such as when you took the loan out and the interest rate

              Was it secured or unsecured?

                Thank you for info.
                My wife and I took out this loan in July 2006 for £2650.00 with the holiday time share agent to improve our holiday accommodation but it was all rubbish it did not make any difference.
                the interest rate was 18% over 15 years, we tried over the first few years to get better accommodation but to no avail.
                Which section due you think I should start a new thread ?
