I was hoping someone can help me regarding the above companies. I had a payday loan with Minicredit back in 2012 and fell behind with payments so the £100 loan shot up to £500. Minicredit ceased trading in December 2014 due to FCA strict rules which in effect made them give up their licence. Minicredit were told to write off some accounts and others were transferred to sister company Kapama but the debtor had to be notified by 29/12/14. When an account is reassigned by law the debtor must be informed on the date of transfer. I was not contacted until February 2015 by Kapama that they now owned the debt. Minicredit also had added a default in 2013 on my CRA file.
I have seen a link here that states this debt is unenforceable due to the date of assignment notification and FCA rules were very strict that account holders be notified by 29/12/15. I have asked for removal of the default because the loan was unaffordable and I should not be penalised for this and I have asked for the account to be closed. Kapama are not being helpful, has anyone else had the same problem?
