    Hello All,
    Yesterday I came home to a letter of claim from BW Legal. Have they sent this because it is getting to 6 year point? In fact the original debt is over 6 years old - July 2013.
    What is the best way to deal with this? I made some serious misjudgements back then.
    I am registered as a creditor through the Money Shop as I believe these loans should not have been given to me as I was in financial difficulties.
    Does BW Legal have the right to take me to court over this?
    Any help would be appreciated

    Hey,

    I noticed no one has responded to you yet and I'm familiar with the STL industry, so I thought I'd offer some help.

    Strictly speaking a debt is enforceable until it is statute barred, the main issue is where the barring takes effect from, so it's possible their solicitors have started action because its approaching the date when it will be barred. If they're still acting for ICL, it's also probably motivated by their desire to recover as much money as they can before winding up for good.

    What's the letter you've received from them? Is it a pre-action letter or some other form of demand?

    To answer your question directly, it's entirely possible they do have the right to start proceedings, but its hard to say for definite without knowing more.

      Hi go to the money shop web site they have a claims portal if you have not received an email from them you can register anyway .. money shop went bust and administers looking at payments that may be due from loans given out when not qualified. Debt camel have advice on what to do if referred to debt collector but register on the money shop portal anyway

        So tell them that the debt is statute barred. Let them tell you when the last payment was made.
