    so far the two threads ive posted on are sorted

    brian carter given up as no debt
    hbos told me on friday the default will be removed within 48 hours
    so now this lot have cropped up

    i know i was stupid now but two years ago i took out a payday loan with this lot. i got into dispute when they called the direct debit two days early. as no funds on the day pounds till payday charged me seventy pounds for non payment. i refused to pay the charge so they passed the account to a dca called clarity. to say this dca is the lowest of the low is an understatement.
    in the end they gave up.
    yesterday received an irate call from my brother as clarity had phoned them saying they were a dca collecting for pounds till payday.
    talk about a breach of the data protection act.
    i know most of these agreements are crap so i sent them the email below.
    after allmost three years i have no default from them, the thing is ime tempted to pay the £200 rather than get a default. i have a clean credit file at the moment.
    if any body has had dealings with a pay day loan company or clarity i would welcome the advice

    i have just had an irate call off my brother after a debt collection agency contacted him ref an account with you in my name. the collection agency concerned is called clarity.
    i must inform you i have spoken to trading standards over this matter.

    clarity informed my brother that they were a debt collection agency contracted by your company to collect on an account. no doubt you are aware this is in clear breach of the data protection act.
    if an account is outstanding it will be settled but as i am not aware of this account, under legal advice, i require under s78/79 of the consumer credit act a copy of the agreement and statement of account.
    i must inform you that as clarity are operating under your instructions, you are responsible for there actions.
    i am giving your complaints department first opportunity to investigate this matter as it is a condition of your consumer credit licence
    as i have put this alleged account into dispute i require with immediate effect the account be withdrawn from clarity back to pounds till payday.
    upon your reply will decide if i contact the information commissionaires office on the matter of the breach of the data protection act.
    i also intend sending a complaint to the financial ombudsmen and the office of fair trading to decide your fitness to hold a consumer credit licence. i must inform you to take this letter as a seven day letter before action notice.
