OMG Help iv my claim in,Now bank want to see me dont know what im meant to do???????

Hi All

Im new on here.

I started my claim around 5 weeks ago as im in hardship. I didnt hear a thing so rang the bank they said manager would ring next day (DIDNT) 3 Days later i got a letter saying they are looking at my case and i will hear by the 7th then this morning a got a letter asking me to ring and book to see them has they want to speak to me WHY??? They have asked me for my income and out goings also but they (DIDNT) send a form. I get DLA and IS thats my only income. The bank take loads of charges out of this and i dont understand why when i have (no) DD IE went bank sat was ment to get 150 they had took over 70 off it went to bank today ment to get 55 they had took 35 again no clue why. So how can i tell them my income when they take over half?


What i need help with is what am i ment to bring to them?

How do i do up income out goings when they take most of it.

Is it not the case when they take over 500 in a year (which they have) your seen has being in hardship?

Someone plz plz help me

Also which bank is this and what action have you taken upto yet?

Yes, it is the case that if the bank take £500 or more from you in charges within a year you could be considered as being in financial hardship.

Welcome,

You have alot of reading to do but this site will change your outlook on how the bank is seemingly creating severe and genuine hardship for you.

at very least the banks can not and should not take moey off you which is essential to your well being.

Customers who are experiencing Financial Difficulty?
The FSA has indicated that the bank and building societies must continue to deal with unauthorised overdraft complaints from customers who claim to be in financial difficulty. Such complaints fall outside the terms of the waiver. A complainant is considered to be in financial difficulty when their income is insufficient to cover reasonable living expenses and meet financial commitments as they become due. If you feel you are in financial difficulty please contact your Bank of Ireland branch.

I sent off for the list and got it. So the very next day i sent in letter number 1 asking for my money back giving 14 Days did not hear anything from them. So then sent letter two saying i was in hardship and would take them to court. 10 days after still didnt hear anything so rang and was told the manager was dealing with it and would ring me the next day which she didnt do. 2 days later got a letter saying i would hear the outcome by the 07/04/09.

But then this morning i got a letter asking me to get together all the info on what iv coming in and whats going out then once id done this to ring to see the manager. They didnt send me a form or anything. Iv lost the 2500ish in the past two and half years and near a 100 in past few days. I dont know what im ment to do now what stuff would i need to show them

firstly, have a read of the links others have already posted for you. And calm down. Don't panic. Fill in the Legal Beagles IE sheet, this will help to put your income and expenditure into perspective and give us a clearer picture. If you don't want to publish the IE sheet on here, send it to a member of the site team.

Here is the I/E Sheet or Income Expendiutre Sheet. It lists all your outgoings and incomings and calculates how much spare money you have, if any. It will also show percentage payments to offer creditors as well

It has many of the main components of the MAT IE forms that the banks issue, so will cover all the necessary items.

Basically fill it all in as much as you can. Only base it on real figures.

Other documents to show the banks, will be letters from Mortgage companies showing arrears, tax arrears, letters from debt collectors, that type of thing.

For the bank you will have to leave all the details in.

For us Its better, if you real the creditors names in and remove your personal details. If we know the creditors we can help advise with regards to how to deal with them.

Once again a big big thank you to you all for getting back to me. Sorry it took me so long was away overnight.

Ok so i have spent today doing up a file for the Bank just hoping what i have in it is right....

Iv put in so far

My letters to the Bank.

There letters to me.

A list of the 6 years of charges.

A 2nd list of charges for the past 12 months Total of £1319.82.

My Income and out goings.

Copys of every letter, Bill, overdue payment (There is alot)

So was wondering will this cover it or do i need more?

Also is it true the bank cant take chages from my benafits? Just i seen this paice on an other site.

Social Security Administration (Northern Ireland) Act 1992

Certain benefit to be inalienable
(1) Subject to the provisions of this Act, every assignment of, or charge on—
(a) benefit as defined in section 121 of the Contributions and Benefits Act;
(b) any income-related benefit; or
(c) child benefit,
and every agreement to assign or charge such benefit shall be void; and, on the bankruptcy of a beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors


Does this mean they where in the wrong to take it from my benafits in the frist place?

glad to see you are getting some help.

Have you considered opening a basic account with a credit union or something similar to a post office account so they can not deduct the charges from you in the future?
