  • Settled Hardship case ? Need your help to help others.

    I am writing a press release to highlight to other possible hardship claimants that it IS possible to get a refund of charges and help with your situation from the banks, despite all the negative publicity about hardship claims.

    We know they can be difficult so i don't want to make out it is easy or the banks are rolling over, but I would like to highlight that people should still try if they are in severe hardship and also publicise the facts of successful cases.

    I would be very grateful if, rather than me trawling through threads and summarising cases, if you could do a wee paragraph about your circumstances, the bank you claimed from and how they handled the hardship.

    I won't use names or identify anyone.

      Amethyst, my case, although still pending, has been a fax to DG Solicitors, followed by about three calls, one where they asked me for income an expenses, and then today (approx 2 weeks after fax) a verbal offer to be confirmed in writing. The bank is HSBC.
      Feel free to use any info.

          I will post up my progress tomorrow, anyone who wishes to use any part of it that may be useful to them please do, Although my case is still in progress I will update it as and when anything happens. Like I have said many times its thanks to this site I have got as far as I have and I want to help others no matter the outcome of my own.

            The main part of my case is posted on my thread, as is the letter received from Abbey on Friday morning, but the events have unfolded as thus so far(after receiving some great help and advice on this forum)

            16th Feb 2009 - main package sent to Abbey,included letter of explanation telling how and why I feel I qualified for considered a hardship case,(medical conditions marriage break up etc) all bank statements from the start of claim, I&E sheet, charges and interest sheet since claim began,proof of all debts listed sent next day before 1pm special delivery, - confirmed as received by Abbey on 17/02/09.

            02nd Mar 2009 - posted notice of AoE to Abbey by recorded delivery. (confirmed as received.

            09th Mar 2009 - Telephoned Abbey complaints for update told is was with their team but no further charges would be levied until case is completed.

            17th Mar 2009 - faxed 6 page document to Abbey complainrts dept confirming rent arrears, utility bill and covering letter - proof of fax delivery retained.

            17th March - Telephoned Abbey complaints to confirm they had documents faxed and to enquire about charges being stopped told it was until OFT case was settled.

            19th Mar 2009 - Faxed further prrof of debts and covering letter proof of fax being received retained.
            Telephoned Abbey to confirm receipt told claim was still with their team.

            20th Mar 2009 - Received letter From Abbey ( full contents on thread) apologising for the delay in my complaint being dealt with.

            22nd March - faxed Final demand Utility bill to Abbey complaints proof of fax being received retained .


            I intend as always calling them tomorrow to confirm receipt and ask for progress.Thats my story so far since the claim was held pending the OFT case ( soon be 2 years!) Hopefully there will be a happy ending,tha fact charges have been stopped I am told is a good sign so heres Hoping!

            I would just add that I found it helpful to keep a wee diary to list all calls and correspondence so I dont get mixed up nor miss anything out.
