    This feller is in unquestionable hardship from what he has posted I believe the banks will turn him down flat but the FOS will give him a fair crack of the whip.

    We are all finding things tough at the moment but would you swap your life for his?

    In making an assessment of financial difficulty the Bank will take into account:

    a.
    evidence of
    changes in lifestyle, (Had to Give up Smoking to afford to survive) including loss of employment (YEP); disability; serious illness; imprisonment; relationship breakdown (new Partner); death of a partner; starting a lower paid job; parental/carer leave;(New Baby) and starting full-time education;
    b.
    evidence of the following events:
    i.
    items repeatedly being returned unpaid due to lack of available funds;
    ii.
    failing to make loan repayments or other commitments;
    iii.
    discontinuation of regular credits
    ;(Meters on household utilities, if that is not a discontinuation what is)
    iv.

    notification of some form of insolvency or court proceedings; eg eviction application
    v
    regular requests for increased borrowing or repeated rescheduling of debts
    ;(Every time you buy a meter top up you are rescheduling your debt aren’t you ?)
    vi.
    making frequent cash withdrawals on a credit card at a non-promotional rate of interest; and
    vii.
    repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty).


    Striker If you don’t feel you are in hardship having read the above threads then don’t bother, if you feel you need to apply just say the word...nothing beats a try!
    The charges coming in to the banking industry every day will more than pay the banks total legal bill for the whole test case so why wouldn’t the Banks want to "ensure Justice at the highest level"

      It depends on the circumstances - I am on meters and not cause of any debt - simply because its the only way I can manage money. If I don't have the money, i don't have the electric.

      A low income just won't qualify for hardship. It is wrong, the money is his and the bank have taken it unfairly, however because he has managed to live within his means on the income he has and avoided getting into debt there will be no immediate need for a payout. They might move him to a basic account etc (they already tried to sell him a loan grr). He has already asked to be considered under hardship so the next step would be the FOS - natwest are hardwork anyway - just wouldnt want to give false hope. The refunds people are getting are in the main geared towards the essential arrears, think Abbey are now the only ones doing a percentage of the claim.
