  • Help with hardship case

    Hi ,

    i recently had contact from the HSBC saying that they agreed i was in financial hardship after shoing them all my details .
    My bank charges claim is originally for £4500 which was stayed by the courts .
    When the Hsbc contacted me to agree i was in financial hardship they offered me only £340 which i turned down very quickly . They said that they would note that i had turned down this offer and that was all .
    Can anyone give me any advice on what to do now . How do you go about asking the courts to lift the stay so the my case can be heard again and does this cost ?
    Any advice would be most welcome .

    Hi Charliebeth and welcome to Beagles.

    On what basis did you claim hardship, what evidence did you send to them i.e arrears letters etc. Did the £340 cover a specific debt that you informed them of?

    Did you provide them with a Financial Statement?

    As for applying to lift the stay on your claim I'm afraid in most cases this is a pointless exercise.

    The best and quickest course of action is to pursue HSBC on hardship grounds.

      Hi , thanks for your reply .

      The information i gave them is as follows :

      I am currently unemployed , receiving only jobseekers allowance .
      I sent them debt letters that i have at the moment that i cannot pay anything towards , the are :
      Loan , outstanding £3500
      Credit Card , outstanding £500
      Hire purchase , outstanding £2100
      Gas and electric bills outstanding from my previous home which was repossessed last year totalling £1100 .
      All of these debts have been passed onto debt agencies at the minute of which i cannot pay anything off them due to my current income .

        Of those amounts, how much are immediate arrears and not outstanding balances?

        Is the loan secured or unsecured?

        Are you up to date with your priority debts such as mortgage/rent, council tax etc?

        Do you have any court action pending from any of your creditors at all?

          Hi ,

          They are all immediate arrears , all are demanding full settlement as i havnt paid anything for a while now

          The loan is unsecured .

          My home was reppossessed last year so i dont have a mortgage now , i live with a friend who i just pay rent too .

          The hire purchase debt of £2100 went to county court and i have a ccj from it but cant afford to pay anything off at the moment .

          2 of the other debts are now threatening county court action , all of which i explained to the hsbc .

            OK thanks for that info I know it isnt easy to list but it is essential we get the right info from the start, so thank you for taking the time and courage to give the info.

            Would it be possible for you to scan / write out any letters to and from HSBC together with your income/expenditure sheet. Please make sure any personally identifiable details are removed first.
