    Hi,

    I completed relevant paper work given by Natwest at the end of the year. I rang them today and was told that my case was passed to Natwest Hardship Team. Few minutes later was told that my claim was REJECTED as i was given a loan in December 08 for 1000 (and that's correct) and this is the reason why my claim was rejected. I explain to them that i have financial hardship and loan provided in December did not covered really any my debts and still at the moment i have little money. Was told that I have still rights to appeal against the decision..
    Can someone please help me?!?
    I don't know what to do now and where to go...

    I'm not the best to respond about Hardship claims bit I am sure someone more equalified than me will be along shortly.

    When you did the claim did you fill out an Income and Expediture form and show exactly why you need the money?

    I saw somewhere that Natwest only refund if you are about to lose you home, will have to check if that is still the case though.

      Many thanks for a quick response.
      Income and Expediture form was completed. I have even copy at home. I explained to them already my financial diff and explained why i need money..

        How is YOUR Bank dealing with Hardship Claims ? - Legal Beagles Here it is, I knew I had seen it somewhere.

        NATWEST
        A hold on future charges and allow overdrafts to be repaid by installment without default. They will not refund unless there is an immediate threat - ie loss of home / bankruptcy

        What is your financial situation right now, (obviously not great or you wouldnt be claiming hardship) is there anything else we can elp with other than the hardship claim?

          I'm sorry to hear your having trouble with your hardship claim, I'm not that up on them but there will be someone along who can help soon enough.

          Can you give an outline of your situation as it stands now please. We may be able to help you more if we know whats, what first.

          Can I ask what was the loan for also ?

            I am posting for you here the Hardship rules as laid down by the FSA. If you meet any of these rules then please let us know and we will guide you from there.

            Alsp. did you send them evidences of your hardship when you sent them your income and expenditure summary.

            If you meet ALL or even ANY of these criteria then your Bank will have to be SYMPATHETIC and POSITIVE when considering these difficulties.

            1. The firm will be sympathetic and positive when considering any financial difficulties claimed by the complainant. Firms will not subject a complainant to harassment or undue pressure when discussing their problems.

            2. In making an assessment of financial difficulty the firm will take into account:

            a. evidence of changes in lifestyle, including loss of employment; disability; serious illness; imprisonment; relationship breakdown; death of a partner; starting a lower paid job; parental/carer leave; and starting full-time education;

            b. evidence of the following events:

            i. items repeatedly being returned unpaid due to lack of available funds;
            ii. failing to make loan repayments or other commitments;
            iii. discontinuation of regular credits;
            iv. notification of some form of insolvency or court proceedings;
            v. regular requests for increased borrowing or repeated rescheduling of debts;
            vi. making frequent cash withdrawals on a credit card at a non-promotional rate of interest; and
            vii. repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty).

            3. If during the handling of the complaint the firm becomes aware (including by notification from the complainant) that the complainant may be in, or heading towards financial difficulties, the firm will contact the complainant to outline their approach to financial difficulty cases and to encourage the customer to contact the firm if the customer is worried about their position. The firm will also provide signposts to sources of free, independent money advice.

            4. The firm will make available to complainants straightforward information in plain English on the firm’s procedures and systems for dealing with customers in financial difficulty.

            5. If it becomes clear to the firm that the complainant needs specialist assistance, the complainant will be referred promptly to a specialist team that deals with customers in financial difficulties, if one exists. The firm will give a phone number on all communications that will put the customer in contact with a named person or a team dedicated to dealing with cases of financial difficulty.

            6. Where the firm does not have sufficient evidence to assess whether or not the complainant is in fact in financial difficulty, the firm will seek such further relevant information as is reasonably required to make that assessment. In the event that the firm reasonably requires relevant information to be provided by the complainant and the complainant does not provide the requested information within a reasonable period of time, the firm shall not be obliged to treat such a complainant as being in financial difficulty.

                is great and Im sure you all helped already many people


                sapphire - the loan... i rang Natwest in November
                for assistance in re-paying current debts. Was offered the loan for 3000£ but application was rejected. I explained to Natwest Agent that I owe money to few payday loan's companies and paying back huge interest and at the moment was still repaying old credit card debts. Was transferred to "Collection Center" I explained what happened again etc..
                I almost cried on the phone begging them for help as even have no moneys to pay rent, council tax, bills at the end of the year
                Was "kindly" offered 1000£ to consolidate my debts.S
                350£ from loan was paid towards Natwest Credit Card within 48 h
                And that's all.
                I managed to pay rent, outstanding bills and now back to the same situation.
                Recently made another overdraft so I believe will be charge at the end of the January 2009
                for borrowing..

                  Hiya

                  Probably a stupid question but have you managed to claim back any charges on cards, bank accounts or anything.

                  Have you supporting evidence that you are behind with rent, council tax etc that you can send to Nat West hardship team, I know you have probably already done that but I'm double checking hun.

                  Perhaps a strongly worded letter reminding them of their responsibilites might be in order, and I know just the lady who can compile one if we ask her very nicely. Eh Amy ?

                    This is not good enough and the decision needs to be appealed. You were obviously dealing with some idiot not familiar with the hardship rules.

                    Would you be able to post up your IE sheet or PM it to somebody if you'd rather? It would really help to see it.

                    How much do your charges amount to?

                            it has been now 7 days and still no letter at all. Information about my claim that was rejected I received on the phone on the 28th January 2009.
                            I need to complete the IE and will post here as soon as I can

                              When you've done the IE form post it up on here, then we can have a look and see about appealing Natwest's decision.

                              Also, as Sapphire asked earlir, have you reclaimed any charges on your credit cards yet? This is fairly easy to do, especially with Capital One and Natwest credit cards. They are not affected by the OFT case, so you could make a start on that also. You may end up with money back, or the balance on your credit cards reduced, but either way, your debts to the credit card companies would be reduced.
