  • Abbey hardship claims.

    I thought i would just let you all know what i have just been told By Mr Coyle at Abbey.


    Abbey have a way of dealing with Bank Charge Claims.


    If you have started to go through the courts then you can contact him, though he really is snowed under with over 1000 emails a day.

    However only contact him if you have a Court Claim.

    Otherwise it's just called a Complaint and you will be delaying your Complaint.

    You need to contact Abbey.
    Location AHM243 needs to be added to your mail as this is section dealing with complaints.

    Thanks for the info - the more we know the better!! I have been in regular contact with Ronan at Abbey (as have a couple of others on here) and it seems that there should be a letter being sent out on the 5th Sept explaining what Abbey's next step is re the court claims looked at under the hardship wavier.

    Further Info after call to Ronan Coyle......

    I have just rung Ronan and apparently there is a batch of claims that are being looked at and a decision regarding whether the claims sent in that batch meet the hardship criteria Once Abbey have looked at these and made their decision the results will be sent back to Ronan (i.e yes it meets the criteria or no it doesn't) and if it has met the criteria then Ronan will negioate a settlement figure with the claimant and a cheque will be sent to said claimant within a week (or sooner). Ronan said that it is Abbey causing the delay deciding what claims meet the hardship waiver, once he has the go ahead he said things will happen very quickly to be resolved.

    Looks like the 5th will be a very busy day for Ronan!!!!

      Thats just really bizarre. Although great for the claimants in trouble temporarily. I guess bunging them a refund is easier than assisting them with their financial difficulties. Comes back to the quota.

      Will await the 5th and watch the following couple weeks with interest.

        I think the difference is the stayed Court claim aspect, which makes sense.

        I think all of our Claimers who have applied to Abbey via Ronan to have their claims processed under the FSA hardship guidelines all actually do have stayed Court claims.

        So yes, next few days will be very interesting.

          Talking of which......

          Ronan did say if i called him back after 2pm he "may" have some further news for me. So after patiently watching the clock at 2 seconds past 2 (well i didn't want to appear too eager did I!!) I phoned him and I got this update........

          Abbey have almost finished looking at the backlog of claims Ronan sent to him. According to the person he spoke to, Abbey are returning their decision re each claim to him by either the end of business today or first thing tomorrow. Ronan then said he will contact each claimaint in turn and inform them of Abbey's decision and take appropriate action in accordance with Abbey's instruction. Ronan said that if he receieves the paperwork back today he will start calling people immediately.

          Hope that helps, when i get my call i will let you all know!!!!

            Outspoken.. thanxs for that bit of info. I called Ronan this week too but he didn't elaborate whether my o'h was included in that batch.. but am hoping he is lol... will be giving him another call in a mo and see if he knows if my o/h is included in that 'hardship batch'.

            Its also very interesting to hear what you just said about Ronan quoted as saying that "once claims have met the hardship criteria, he will negotiate a settlement figure with the claimant and a cheque will be sent to the said claimant within a week or so".....

            Am quite surprised he said that tbh.. thought the would put up a bit more of a fight, or just stop further charges etc... but it seems he wants a speedy resolution too...

              I think he's probably fed up with all the phone calls!!! Once he settles the claims then perhaps he's hoping the constant calls asking for info will calm down a bit.

              I do feel kinda sorry for the guy, he must be as fed up as we are with Abbey!!!

                It all sounds very encouraging.

                But please take a moment just to re read Ladidi's thread as the principle is likely to be the same.

                Ronan, will attempt to get you to accept a percentage of your claim ( maybe 70-75 % of the value of your claim)

                He will attempt to get you to accept this in full and final settlement.

                Now, you are all aware that according to the FSA waiver he shouldnt actually be doing this. But you don't want him to know that you know !!!!!

                Please do not jump at the first offer he might make you. He has indicated that he will be negotiating, which means he will probably be able to offer more than his opening offer to you. Also ask him to confirm whatever he is offering in writing ( ideally by email ). Say that you need time to think about what he is offering and speak to other half etc etc.

                Please please please do not get into any dicussion with him about full and final settlement, just ignore anything he says on the subject, we will tackle that side of things in email responses to him.

                Fingers crossed for some good news later today or over the next day or so.

                    Have just posted over on my thread (BF v Abbey) about not accepting the first figure Ronan offers.. Thankyou Bud ! Tho, it is rather tempting but we will stick to our guns and confer with everyone on here of where to go from there.

                    In the meantime my stomach will be in knots the next couple of days ! :eek2:

                      If you get a pay out do NOT discontinue your claim. Have it noted as a partial payment. You need court fees and your place in the queue for the remainder.

                      If they try and say they won't deal with you as a hardship case if you refuse to discontinue they will be in poop. They are dealing with only court claims for a reason and I doubt if its out of the genorosity of their hearts.

                        Hi Bud,

                        Ronan has agreed to settle my claim 65% - they were non negotiable on increasing the %. My needs were that it was better for me to accept this payment now than not at all.

                        The money will be in my bank mid next week. I am also not being asked to sign or to write an acceptance as this was agreed over the phone. He told me that my rights were not predudiced in any way and therefore my claim will stay in place untill after the test case.

                        I needed the money NOW so hence the instant decision. I guess if others do get a higher figure I could go back and argue as my rights were not affected by taking this figure now and it was definately not in full and final.

                          Tuttsi - does the figure equate to any specific need as opposed to a simple precentage rate ? eg. two months mortgage payments or something?

                            No Ame, he just said it was 65% of my charges claim, it is under 2 months mortgage for us, as you know we have a very hefty mortgage which includes the arrears.

                            But it does cover arround 17 months of the mortgage arrears of £250 per month, which is the extra we are paying over 4 years and this money will be there as backup and it will really help, as I intend keeping it for any month that we are unable to make the full payment.
