  • Baliffe removal

    Hi, my car has recently been taken from a public highway by baillifes under what i believe to be illegal means. They did not contact owner at the scene to notify them, my wife returned to the place where veicle was parked to find it gone. There were belongings such as child seats and house keys, money inside. The bailiffe is stating that they notified the owner at the sit but this is untrue. Car is now in the pound. Was left with no info for where it has been taken and no chance to pay or make a payment agreement. Company is Martsons and the are acting on a dept from a parking fine.

    I was told by a friend who saw the clamp on car and sent me a picture but at the time there was noone from the agency there.

    What are my rights and what can i do to recover?

      Was this for a Council or private parking ticket? Did you know about it? Is your car registered where you presently live?

        I beleive a council ticket. Did not know about it. Yes its registered where i live but was taken from a different area.

          I believe a council ticket. Someone had put a letter under my door a few days before. Car is registered where i live.

            If you never received any letters/documentation about this previously then youwill need to find out what has happened and where they have gone. In the first instance you should contact the Traffic Enforcement Centre telling them you received nothing until the car was removed & you also need to ask what address is on the ticket.

            The car pound will only be interested in payment in full.

              Address is our flat. I feel they did not take the correct steps at the scene of removal. I have seen many cars clamped and left for days without removal. Do they not have to notify or identify the owner at the scene? Or make sure that the owner is not vaunerable?

              Its left my wife without a mode of transport with three small kids that need to be carted around. Also she is on income support, would there be noway atleast to set up a payment plan to release vehicle and clear dept?

              I had my van clamped the other week police were involved because they called them. Police ended up telling bailiffe to jog on and advised him to remove the clamp as i said i would cut ot off if its not removed. He left it on and i removed it later. This was at my address where van was registered.

                They are only required to put a notice on it and can remove after 2 hours.
