    Hi, I am looking for some advice I'm making myself ill with worry. About 8 years ago I broke up with my partner and my finances just went to pot I tried to survive for a couple of years by juggling pay day loans but it got to much I had a mental break down and lost it. I tried at the time to use citizens advice but with no avail.

    In the end I just moved walked away and changed my name for the past 5 years I've been living as some one else not taking any debt on but surving building up slowly my credit rating.

    The other day I received a letter from bw legal saying they had bought the debt from payday uk chasing a small payday loan I got. I can't remember when but I'm trying to go through my emails I think I took the debt out it July 2009. The letter was in my old name.

    The letter asked me to pay offering a discount to pay within 28 days or they would take legal action.

    I have had these letters before but bw legal have a reputation for going for ccjs.

    I checked my credit file which has had nothing in my old name and is clean and there was a search made my bw legal.

    I'm scared if I pay the cost then all my other debts will come out of the woodwork and I'm taking round about £30,000

    I'm also scared of the affect it would have on my credit file. I have worked so hard to survive and turn my life around everything could come crashing back down especially as it's been so long.

    Do I pay up? Send the letters back?
    If I pay up will lots more debt letters appear?
    What effect will it have on my credit rating.

    I live on my own and struggle as it is...

    It's really making me ill and I don't know what to do...

    Please any advice would be great

    A lot is going to depend on when the loan was taken out - or when you last made a payment to it, if you made any payments at all.

    If the loan was taken out in 2009 and you didn't make any payments after 2009 it is now statute barred. In that case you can defend any Claim and shouldn't get a CCJ.

    But "About 8 years ago I broke up with my partner and my finances just went to pot I tried to survive for a couple of years by juggling pay day loans" doesn't sound that certain.

    If you don't want a CCJ on your credit record you either have to be absolutely sure of your dates or you need to offer a settlement / make an arrangement to pay monthly.

    Will other debts appear? Very probably , it sounds as though you have been found. Of course they may all be statute barred.

    Will they appear on your credit rating? Well not for long if the default dates are correct as they should all drop off 6 years from the default date. But some may be added with too recent dates which you will have to get changed.

    As a further complication, if you used payday loans a lot before the last ones you defaulted on, you may have a case for getting a refund of the interest you paid, see https://debtcamel.co.uk/payday-loan-refunds/. But making these complaints will mean you are clearly linked with your old debts. And cases over 6 years old will be slow.

      Thankyou, is there anyway I could find out the correct dates? What would happen if I ignored them as they are in my old name and everything I have is in my new name. Or would I just be better off just paying up?

        You could check your emails. Or your credit records but they often don't help with payday loans so you can't assume an absense means the debt is statute barred. Best of all is to check your bank statements.

        Or you could send the BW Legal a Prove It! letter, possibly following up with a request for a Statement of Account.

        I don't think the fact they are in your old name is going to help much. You have been found. If you ignore it, you are likely to end up defending a court case. If the debt is statute barred, fine, you hopefully will win. But if it isn't you are going to get a CCJ.

        If you pay one of these, you may never hear any more. Or you may get piles crawling out of the woodwork.

          Thankyou, checking my emails I think the loan was took out October 2009, still unsure the best way to act, I really don't want bad credit after years of trying to pull myself round...would sending a sb letter, prove it letter not confirm where I am? and do I respond in my old or new name? Your advice is very much appreciated
