    I'll let the others carry on talking about your defence to this claim, I am just replying here to your
    I physically don't have the money to pay the debts my husband left me with. Feel like I'm drowning with it all.
    and the suggestion you should talk to National Debtline.

    National Debtline 0808 808 4000 would be an excellent place to talk about your whole debt situation. They are a charity and completely confidential. (They are also good at advice about how to deal with Claim forms, but that is already in hand here.)

    When you have got a lot of debts and little or no money to pay them, it is usually a mistake to try to sort them all out individually. If you win this one, then another one will pop up. You can spend years and have a lot of stress and in the end you can't defend one of them and get a CCJ. It may be better now to look at your options including insolvency - if your total debt are under £20,000 and you are renting, a Debt Releief Order may be your best option, see https://debtcamel.co.uk/debt-options/dro/ for an overview of they work. National Debtline can set up a DRO for you if this would work or talk through your other options.

      Thank you for your advice I will contact them Monday see what can be done.

        Sorry to be a pain ! Do I send my defence I've drawn up on it's own or with the defence and counterclaim part of the claim form. Also do I send it to the court that's on the form ? Thank you.

                    Imho, as things currently stand they can argue that there is no valid CCA request pending (they claim that the £1 fee was missing).
                    If it were me I'd resend a copy of the original request to the Claimant (Lowells) with another £1 fee & a covering letter referring to their claim that the fee was not attached.
                    I would also send a copy of the CCA request to the solicitors (no fee with this one) with a covering letter stating that it is for information only, that their client had informed you that the fee was not enclosed with the original, & you have now rectified this by resubmitting the CCA request plus £1 fee on (date).

                    Then you can amend your defence accordingly.

                      To see if your Postal Order has been cashed you will need to write to:
                      Postal Order Correspondence Section
                      Post Office Ltd
                      1 Future Walk
                      Chesterfield
                      S49 1PF
                      You will need to enclose the receipt (please keep a copy) to include the reference number from the postal order, your name and address and a covering letter explaining the problem. Unfortunately, there is no other way to check to see if the Order has been cashed as a trace needs to be placed upon it and there is no facility to trace Postal Orders on-line.

                        Hi kati yes it was and I def posted it with the letter. I shall do as advised by charitynjw and repost as only got this week to reply. And also will be checking if it has been cashed as I know they are damn well lying or more than likely just being awkward.
