  • DWP overpayment of pension credit now wasting time

    Hi, first time posting and joined this site a while ago specially for advise on this as my solicitor isnt on my side.
    My grandfather died over a year ago and left me his property. he has 18k in savings. only in april or may DWP contacted my solicitor and said there may have been overpayment in pension credits and asked for bank statements from 2 dates... however didnt give the dates they had 4 weeks to get those to us... those 4 weeks came and went and they were backlogged so given another 4 weeks... still nothing and eventually after 12 weeks they finally gave the dates they wanted to check against and had 12 weeks to make a claim for any overpayment. Meanwhile discussions with my solicitor i was basiclly told if there wasnt enough money in the estate to pay back the DWP then the solicitor would withold the property until i paid solicitor fees (which was meant to come from the estate) so pretty much i had no choice but to sell anyway.
    Throughout all of this my mental health has been taking a dip as i suffer from anxiety, bipolar and countles other issues. Today was the deadline for DWP making a claim. only now im told theyre backlogged again and theyve been given yet another 4 weeks. Im really lost, Im back living at home and no funds to move out, i dont expect them to just hand the money over but some idea of how much theyre taking would be a start as at the moment im plucking figures from the air. No idea what to even start typing into the pension credits calculator to work it out there either. My solicitor has been absolutely no help whatsoever, i cant seem to hurry them up im literaly just letting them do as they please whilst sitting here twiddling my thumbs

    Hi and welcome.


    I'm afraid DWP are a law unto themselves, and speed is not one of their attributes.
    Any eventual claim will be for any possible over payment.
    You just have to be patient.
