  • Is this Nationwide 2006 Debt CCA compliant and is it enforcable?

    Hi,

    I was wondering if you can help me. I’m currently helping a friend with her debt in regard to requesting CCA’s etc and then making Full and Final offers.

    There is a 2006 Nationwide credit card which has been handed over to Shoosmiths solicitors. A CCA was requested and a month later the following signed document was supplied.



    We wrote back saying that the prescribed terms were not supplied as well as the full terms and conditions. In addition, I offered a full and final offer. 2 weeks later it was rejected and there was no mention of the terms being supplied. Another request was then made and a new offer which was also rejected. This time they sent a Terms and Conditions document which also shows no account holder name within the document. See below:



    I’m not entirely sure this is the correct terms for the account, but I also believe something seems to be missing. The original signed document also has a different card number to the current one and they have not supplied any documentation that I requested to show the change of numbers.

    Can anyone offer advice and let me know if this is also enforceable.

        The card number will often differ so put that to one side.

        The 'general terms and conditions' leaflet won't need the address etc details on as it actually forms part of the agreement. ( On the signed copy where it states Version CTC Oct 05 ) What makes you think it isn't the correct one ? (I'm assuming there are more pages to the leaflet copy they have sent?)

        On the signed agreement - is there a first page or is that all they sent you ? I'd guess that's all they sent you and if so then yes that fails on prescribed terms ( as you told them) as THAT doesn't have name and address ( of either party ) and so on.

        The default charges would still have been £20 in Feb 06 - changing in / about April 06. The Oct Terms leaflet should have the same £20 as on the signed page.

        Also, when did the card get defaulted ? when was last contact / acknowledgment ?

          Thanks for the reply and thoughts.

          The first attachment with the signature that's the only page they sent, nothing else.

          The second one, they sent the full few, but it looks like standard terms it only has the account standard interest rate on.

          The document with the prescribed terms is still missing.
