BW Legal and Lowell Court Claim - Credit Agreement is to another address

  • BW Legal and Lowell Court Claim - Credit Agreement is to another address

    Hello,

    I've never posted here before because I've found so many other peoples' threads covering the same issues and have been able to follow previous guidance to help me get this far. However, I'm now stuck and could use some help!

    BW Legal are chasing me on behalf of Lowell for a debt and started a court claim. I sent my defence and a CPR and CCA.

    I've finally receive a letter that they were continuing the claim, followed shortly by a Consumer Credit Agreement. The only problem is I've never entered this debt and this agreement is to someone with the same name but it's NOT my address. I have no experience with this stuff and this agreement has no information about this person other than a name, address and customer number.

    What do I do now? I assume I have to prove this isn't me but I'm not even sure how to start with so little information. All I have is that I never lived there, having lived at my house and nowhere else for 18+ years. I don't know if I am being chased for a debt of someone with the same name or is someone stolen my details to do this?

    Did you state in your defence that the alleged debt is nothing to do with you?

      I denied owing any money to the original creditor or entering into any agreement with them. They hadn't produced any documents at the time I submitted my defence so I didn't know have much to go on.

          What is the debt, who was the original creditor?
          You say this has a wrong address is that on the agreement supplied?

            The original debt debt is £304.66 to JD Williams. I know it's not a lot but it's not my debt and I can't afford it. The total amount they're after is £415.48 after fees etc.

            I've attached scans of the Claim Form, and all the credit agreement information they've sent. I've blacked out the information but as I said it's a different address on the credit agreements.

              Do you recognise the address on the agreement have you or anyone associated with you ever lived at the address on the agreement?

                No, I don't recognise the address and I don't know anyone from that county. It's a few hours away from me.

                It's not very useful but I've found two women through Facebook by the same name living in that county. The property on the agreement seems to have been rented out at that time so I can't actually link either of them to the address.

                  It's clear to me that your defence should be that " your are not now nor ever have been resident at the address on the alleged agreement nor have been a customer of the original creditor".

                    Is it possible to change my defence? My original one denied it but didn't mention the address because I didn't know about it at the time.

                    Also, will I have to prove that I've never lived there? Other than just showing documents addressed to my house for that time period I'm not sure how else to do it?
