My sister got married at the weekend. She had hired a wedding company to provide decorations, including an up lighter.
The venue moved one of the up lighters to make way for a photo both she had hired. They are now saying that the up lighter is not where they left it and they cannot find it.
Under the terms of the contract with the wedding company, my sister is liable for the cost of replacing the up lighter. Could she recover this in a separate action from the venue if they were responsible for its loss? (No written contract with the venue so can't check as to their liability exclusions).
