    Good morning, I have been having several issues with Santander over the last few years. The thing is they admit the error was on their part and that they will remove the defaults from my credit file but they never do! It is getting serious now as I am in need of a new car and can not get any credit with the damage they have done on my account.

    We took a mortgage with them mid 2011, in 2012 I started getting letters saying I was in arrears. I called the company with every letter (monthly) to make sure I was not in arrears. Every time they agreed I was not in arrears and they had no notes on their systems of any letters. Eventually the letters stopped and I thought that was it finally sorted.

    In late 2013 I had a knock at the door from bailiffs stating that I was due in court, two days after New Years! My husband contacted Santander who agreed we weren't in any arrears and the summons was cancelled with the courts.

    Fast forward until late 2015 when I need a new car and can't get any credit because they have put nearly 2 years of defaults on my account! I have spoken with them and again they have admitted this is their error. For the last 6 months I have been calling them monthly to see why they haven't removed the defaults. They always had an excuse eg investigating, processing, gathering paperwork. Well last month they said all the paperwork had been sent away and my credit file should be sorted within the month. Low and behold it is not fixed.

    I honestly do not know what to do next? Any advise would be much appreciated!

    Get nasty! You need to write them a letter giving them 14 days notice or you will take the matter through the courts, or jump on the ombudsmen website and start a complaint, have to say they have been great with past issues, and it might make them wake up

    If you write to Santander make sure you make reference to this

    May I remind you that of the recent ruling at the Supreme Court, between Richard Durkin v HFC Bank (Durkin (Appellant) v DSG Retail Ltd and another (Respondents)), that a judgement was established that any lender has a duty of care to ensure that the individual is genuinely in default. XXXXXXXX are also under a duty to exercise reasonable care not to make untrue statements about myself to the credit reference agencies.
