    Hi all,

    I posted a few weeks ago regarding a bebt I believed was SB and being chased, I sent a "Prove it Letter" and got a response today. They have said the last payment made was May 2011. I was on a debt management plan then (totally forgot about it). and I have until 2.6.2016 to reply or they will start proceedings.

    If I believe them, the debt is about to become SB May 2017 and I need some time for it to become just that. I dont believe I owe the money as this debt is not on my credit file. I would have noticed it as I get my credit file at least once a year. What`s can I do next? Can I send the CCA request?

    Yeah Nicole send a CCA request but don't expect anything back .... You can just sit tight and see if they're just huffing and puffing but that runs the risk of action or send them a letter asking when, where, how the payment was made not sure if there is a template letter for that on here .. But CCA template ...vv

      As Stu has said send a CCA request asap to be prepared if they do issue a claim, RW and it's parent company are very litigious.

      If a claim is issued it stops the "6 year clock" on the date it's issued.

        If i send a letter asking When, where, how, are they obligated to respond, that will buy me some time although I dont think it will buy me a year.

        When I send the CCA request they have to send me the original contract right? Do you think (in your experience) they will be able to produce it after 5years?

          What sort of debt is this? CCA isn't relevant for all types of debt.

          Also when you say you have checked your credit file, have you checked all three credit reference agencies?

            It's a cap one cc debt. I have checked experience and eqifax

              Get a CCA request sent and wait for their next move it's unlikely as you say to be statute barred as you were on a debt management plan but if they can't produce the CCA then happy days

                They are entitled to send a reconstituted copy as (long as it is accurate) for a s77-79 request.

                  Companies are obliged to keep records for 6 years after an account is closed.
