Attachment of Earnings help!!

Hello,

Because of my own stupidity I've been burring my head in the sand since I got a CCJ, now a company called Howard Cohen have made an application to the Court for an Attachment of Earnings order. I called them wanting to set up a payment plan, so I could write to the Court and ask them to suspend the order. I'm unemployed, so they wouldn't be able to make an Order anyway but I want to start dealing with this asap.

When I called I was put through to Robson Way who deals with the debt repayments. The lady on the phone asked why it had taken me so long to make contact and I said it's been stressing me out, my husband just lost his job, and I've been foolish and tried to avoid it.

She clung to me saying I was stressed out and said they can put a "notation" on my file which would withdraw the order so I don't need to contact the court. They would then get details of my income to make sure I can make the payments I say I can and they can refer me for help with the stress if I need it. I said I would have to call her back.

I don't know much about this notation and if it's going to benefit me, or make things worse. I explained I wanted to write to the court and suspend the order and make a payment today, but then she mentioned this notation again.

I've researched online but I can't find anything out about it. Does anyone know what this is about and whether I should do it or not?

I've spoken to Citizens Advice, who don't seem to know what this notation is but have told me to send in an N245 form.

So now there's another confusing option.

Hi welcome to LB.

The AEO is useless anyway have you actually received the court order yet? As you are unemployed so even if the order lands on the doormat it has no merit just return the whole thing to the court with a covering letter stating the you are unemployed.
I guess the RW " advisor " means to make a note on your file that the AEO is no good.

Do you have a copy the judgement order please and or the original N1 court claim form that you could post here after removing personal data?

Thank you very much for your help, I'm so stressed out about it I want to deal with it tomorrow and get all the forms sent off so I'm highly thankful for your advice. I know it takes time out of your day to help others and I really appreciate it.

I'll try and upload pictures of both claim forms I received from them (the CCJ and the AEO).

The debt is for £1,700, so I want to make payments of £50 a month just until my husband gets back into employment and I can arrange all of my debts and set up a 'snowball' payment system. Obviously this debt will take priority as its a CCJ. I want to pay it off as soon as possible.

Would you recommend I just call the debt company, set up monthly payments of £50 and write to the Court to tell them and just ignore this 'stress notation'? That was my original plan, but the advisor seemed to be pushing it and it did sound good, but her persistence concerned me and I didn't want to just go ahead with it.

Please excuse the questions.

1. Have you done an income and expenditure statement?

2. If so does it show your proposed £50pcm is affordable and sustainable if things don't work out quite as hoped?
