  • Lowells

Hi, I'm trying to help someone who has received a pre-legal assessment letter from Lowells. I've looked at their Noddle report and there's no mention of the old Barclays debt referred to so I think this must mean that it's now statute barred.

Do you think I should send Barclays a SAR to try to confirm this?

What should I say to Lowells to shut them up?

    Thank you

Not being on your credit file means nothing when it comes to statute barred.

Can you remember the last time you made a payment of any sort or acknowledged this account ?

I believe the pre legal letter may be just another collection tactic but wouldn't want to say for sure without seeing it.

We have had dozens of these threat of legal action letters from these aholes and others over the last 7 years nothing has come of it its I suspect a ploy to get you to contact them so they can hassle more.
Until a solid threat or a CCJ summons comes ignore and file these

What needs to be clarified is the date that the last payment/transaction or written acknowledgment of the debt was made.
It would also be worth taking a free trial with either Experian or Equifax ( the two main credit reference agencies) as Noddle
is not always up to date.

A SAR is a good idea, Barclays should retain records for 6 years after an account has been closed.

              Thank you for your help.

The guy has mental health issues so his recollection and record keeping aren't good.

I'll do an SRA to Barclays and see what that brings and, in the meantime, I'll tell him to ignore the Lowells letters unless he gets something threatening legal action.

On a related issue, there's an entry on his Noddle record linking him by HSBC in 2005 to a woman with the same surname to a local address. He has no knowledge of her or the address and he has an uncommon name. Is there any way he could find out any more about this given it was 11 years ago?
