  • Lowell Solicitors...Im really worried

    Evening,

    Very Very Worried indeed

    i had been receiving letters at my parent address for some time, even had a door step visit from 2 heavys. i sent Lowell soem letters to them acting as my parents but they continued to bombard them with mail for a person that didnt reside there. on sending that message from my parent i also sent them mail from my current address, but nobody seems to have noticed them.

    my mum moved from the address in January but from around December i noticed i was getting unusal mail....from Lowell
    i came home on sunday after recovering from an operation, opened up my letters today to find a letter from Lowell Solicitors.

    Letter of Claim dated 17.11.16

    We have not heard from you regarding the shop direct account and are instructed by our client, Lowell Portfolio 1 LTd to commence legal action and issue a claim against you in the County court bulk centre, in respect of this debt. you must contact us to make arrangements to pay within the next 14 days or a claim will be issued without further notice to you. if a claim is issued you will become liable for further court feed, solicitors cost and interest which are estimated below:
    current balance: 1457.89
    estimated interest £116.63
    estimated court fees £105.00
    estimated solicitors cost £80
    estimated total £1759.52

    the letter does go on to say failure to respond will result in ccj entered against my name and they could take further action with warrant of control, attachment of earnings, and charging order

    there are a few things that bother, why didn't anybody in their office notice that i was contacting them from my current address, whilst they were still bombarding my parent? i even offered £250 as full and final payment for the debt some years back but they declined. i find it odd that they have only been sending me mail since the start of this year (i think) why have they reved things up? t
    their client has already said on a previous ppi claim that they didn't have the relevant contract so therefore see the claim as closed.
    if my mind serves me correctly im sure the debt if about 7 years old now.
    My current situation has changed as i was made redundant in November from my career, and currently on income support of £143 every 2 weeks...Yeah!!!

    where do i go from here? i cant bare to go to court, i also cant have this ccj against me either.
    do i pay them? can i send sars and if i did will it put a hold on proceedings?

    Im really worried on what to do

    Have you received a Notice of Assignment?

    When did you claim (or attempt to claim) PPI?

      letter dated 11.02.16 from Lowell

      you have not repaid your shop direct account - as i have failed to make arrangements the account is now being sent to Lowell Solicitors. i believe i may have made the claim back in 2009 or 2010 but i really cant remember, plus i dont have any statement with me either.
      1st letter to my new address is dated 4th November from Lowell portfolio..still chasing payment

        Hello Hotdog welcome to LB

        Lowell are issuing claims very shortly after sending the " letter before claim", so check your post daily, the will use the " last known " address to issue a claim in the hope it goes unanswered and they can then
        apply for judgement by default.
        As the is a regulated agreement, you need to send Lowell ( not the solicitors) a request for a copy of the agreement for this account (CCA) this has a £1 statutory fee, use a postal order and write" For Statutory Fee Only on both sides and keep a photocopy for your records.
        There is a template in the forum library for this. Send by signed for post and check delivery the 12 +2 Working days allowed for compliance starts the day they receive the request.

        Can you please give us some history of the debt.

        The date the account was opened.
        The date the account was defaulted.
        The date of the last payment or written acknowledgment of the debt.
        If you don't have the detail you can check your credit files online Noddle is Free.

          Hhmm a little confused. logged on to see that Shop direct have made a log against my credit for an account which they deemed in thier words unable to locate a copy of the original signed credit agreement, we will not be pursuing the the above account for the outstanding balance.

          then there's another log with Lowell

          18/01/2012

          think i need to contact shop direct for all the info on this Very account.

          its a different subject but how can i get the log against a closed account removed from my file?

              Its a very good thing that you have sent the CCA request to Lowells

              When the CCA comes back try to check for little but important things such as the wrong address on the agreement , this once happened to a friend of mine, the agreement sent back was the current address whereas the account had been opened at an older address

              Does the letter say it will result or it may/could result . If it says it will result that needs flagging up as it is a breach of guidleines although it won't do you any good

              Try not to worry , even if it does come to it you can not be forced to pay more than you can afford and on benefits you can probably not afford more than £1 a week maybe even £1 a month.

                Hello Hotdog.

                I am sorry to say that not having the agreement does not prevent the creditor from reporting to the credit reference agencies, pursuing payment or selling the debt to a 3rd party.

                There is also the possibility that a compliant " reconstituted " agreement may be supplied.

                It is right that SD's entry shows side by side with Lowell, this shows the correct picture of the conduct of the account.

                The Default Date on Lowell's entry Must be the same as on SD's entry which now show that the account has been " settled"
                i.e. Lowell has paid for the debt.
                All seems to have been correctly done so far.
                There have been a few SD debts where " short " agreements have been supplied showing a " tick box" signature.
