  • Capquest court form

    Hi everyone looking for some help
    Cap quest have sent me a suspended attachment of earnings order they have obviously brought the debt I'm pretty sure it was statued barred, tried talking to them the man on the phone was so rude so wanna get rid of this best way possible any help on how to do so would be fantastic and stress lifted of my shoulders

    Good morning welcome to LB,

    It's not a good idea talking to companies like CapQuest it's best to keep everything in writing.

    Can you tell us about this debt.

    Did you receive a County Court Claim?
    Did you acknowledge service of the claim?
    Have you received a judgement order?
    What was the debt for?
    How much was the debt?
    Are you employed, self employed or receiving benefits as your only income?

    For Information Statute Barred in England and Wales = 6 years with no payments or written acknowledgments of the debt.
    The start of the relevant 6 year period varies according to the type of account.

    To us statute barred status the debt must be stat barred on or before the court claim was issued.

        Hi guys thanks for your reply
        At the top right hand corner it has
        The name of my local court
        Followed by
        Application no
        Judgement creditor ref
        Judgement debtors ref

        Followed by a county court crown stamp

        The letter then says the court has made an attachment of earnings of this case
        For the amount owed

        The court orders that is it done etc



        It looks as if drydensfairfax solicitors are the people who are wanting the payment

        Has this gone to far ? Never had any pre warning letters from capquest this just came
        Outta the blue

          I suggest that you check The Registry Trust (Trust Online) that hold a record of all the
          England & Wales judgements there's small charge for each address checked.

          I would also write to Drydens requiring them to provide details of the original creditor,
          the address to which a claim pack was sent and the date the claim was issued.
          State that you have no knowledge of alleged debt nor have you received a claim.
          Could you answer the other questions in #post 2 please.

            I dont believe i was sent a county court claim
            the debt was for a capital one credit card, im employed
            hope the attachment makes more sense

              OK Dean,

              The order is suspended as long as you pay the amount ordered " punctually "
              otherwise your employer will be instructed to make the deductions.

              The first payment was ordered to be made by 21/12/2015 do you make that
              payment?
              As the judgement order has reached you it seems that the claimant had your
              correct address on file correct?

                Yeah they have received 2 payments so far, can I not dispute it? Or do I have to continue paying it until paid off
