    Hi,
    I'd like to ask for some clarity.
    I found a letter on Friday from B&S that they showed up and I'm owing council tax to a city I lived in 4 years ago, £433 including £235 enforcement fee. It also includes they'll break the door lock unless I pay asap (among other things)
    Problem is I don't think I owe council tax there in fact I know I paid up. I moved and the last instalment was forgotten when changing bank accounts but I paid when I got reminder to my next address. Half yr after I paid up B&S did this showing up leaving letter and I complained to them and the council because the letter didn't even include a name but had a handwritten message "don't contact the council or our office no one can help you only paying me will help you" with the complaint I asked for proof I owe the council tax in the first place. I never got response and none else showed up so I thought it's clear I didn't owe it.

    But now I'm threatened again, the amount is higher too by approx £100. I know I don't owe the council tax!! I know it's enforcement fees AFTER I paid up the council tax to the council, at least that's what I assume.

    How could I get proof of this? Should I submit a SAR to B&S and the council to finally get why they are still after me?

    Also should I pay AND fight it to avoid them breaking into my house taking stuff (they won't even know what's mine what's the landlords!) or should I just submit the SAR? Should I submit it requesting enforcement stops until it's established whether they can prove I owe the CT?

    And if I pay now and there's no proof, but definitely will submit a claim to get back my money though, I know I paid the CT. It cannot be CT what they want me to pay but they claim it is.

      Hi, I'm so sorry, I have no scanner.
      It's a printed form where they just fill in who they were looking for and what is the debt for and by when it should be paid & how much the debt is. The rest is printed, it includes a list what additional costs I incur if I don't pay that includes price of locksmith breaking into my house, that freaks me out. So I assume it's a B&S standard form or something.

      The debt is called council tax, and at the payment deadline the "pay before" is crossed by ink and it's written on it "asap ".

      Looking into my questions, please could you advise?
      I definitely want to fight it because I know I don't owe the council tax. In fact as I wrote above they started this enforcement approx half year after I paid up, and when I questioned they disappeared, until now.

      My question is shall I pay it and fight to get my money back? That sounds foolish (I'll never get it back if I pay it) but I don't want them breaking into my house.
      Or shall I submit SAR to B&S and another to the council and not pay? I know I don't owe council tax to that city council.

        You should contact the council directly ... if their employed contractor (bailiff) is threatening to break in to enforce payment, they have broken the 2014 regulations. A formal complaint to the council - who are ultimately in charge of the bailiffs they hire to recover CT debts - and possibly a SAR at the same time, asking for copies of any correspondence, screen prints, notes between the council and the bailiffs regarding your account as well as everything else they have on you (they might not give you the bits for the bailiffs but it's worth asking for )

        At the same time put in a formal complaint to the bailiff firm (not through the bailiff involved). Tell them that the debt is in dispute with the council and request they cease all collections activity until the council has got back to you.
        As the debt is for CT, the bailiff cannot force entry.
        Debt is like any other trap, easy enough to get into, but hard enough to get out of.
