Ccj case put on hold?

Hi everyone

I've followed the information on this site for a few months now, having been issued a ccj claim from Cabot via mortimer solicitors. Up to now I've not needed to post, as the information here is plentiful and spot on. I have responded to the claim, sent off the cca request to Cabot with a postal order and the cpr request to mortimer solicitors. Mortimer solicitors agreed to an extension and asked me which of the documents I requested I had in my possession. I replied saying none, and have just received a reply saying my case is on hold whilst they consult their client (Cabot). What does this mean? Do I still file my defence? I got the standard 40 days letter for the cca from Cabot. I completely deny this debt.

You need to do your defense as normal . there are few templates here you can use . Also you need to inform the court that Mortimer has agreed an extention .

Thank you! I did think as much but just checking. Should I chase the solicitors or leave them to it? I informed mcol by email and posted to the address of the court on the claim with a photocopy of the extension letter. I was just side tracked by the on hold part and couldn't find any advice already given. I am sure there is nothing they can come back with, this cannot be my debt, I don't have any creditors other than my mortgage!

How long you send your defence in time you'll be fine. You can send a follow up letter to the solicitors but is optional.

Yep as Icrina says, ignore the on hold 40 days letter from Cabot. If you had a formal extension agreement from the solicitors running the claim ( which would of been a maximum of 28 days) and you have informed the court of that, then you will need to put your defence in before that runs out.

So that would be date of issue of claim + 33 days + 28 days = new defence date

Otherwise stick to the original defence date ( issue+ 33 days)

Thank you! And I can just sit back and leave the cpr request too? Like wait for them to come up with the goods? The particulars of the claim don't even mention a default, so I've been pretty low on the ground for what I was able to ask for. I feel confident, but don't want to let myself down by not acting appropriately this end. Thanks again guys, this site has no doubt saved a lot of people a lot of stress and money!

Yep, let them get on with it. The particulars of claims from these companies does seem to be getting vaguer and vaguer as they try to avoid having to give any documentation out.

Just keep an eye on your defence date - have you read the example defence and other peoples defences so you are prepared with the next bit?

The only thing that I can add please before your 33days is up phone the court just to double check that the extension was acknoledged by them .In my case I phone by chance on the exact 33rd day and the court failed to acknoledge my 28 days extension so I had about two hours to prepare and send my defence etc . I submitted my defence , unless order and the n244 form at the same time .The claim was struck out few days later so I had a bit of luck !

Hi again

I submitted my defence back at the beginning of February and I received a letter from the court acknowledging it. That's it. I've heard nothing since. Where do I stand now? If they've not come up with the goods by now (I knew they wouldn't, this is nothing to do with me!) surely they won't be? And surely this case can't sit on hold forever?

Any advice welcome.

You'll have to phone the court and see what is happening , is a long time to just be sitting there .
