    I am currently assisting a family member with a Default that has been filed against them with Call Credit, However both Credit Expert and Experian are showing as clear.

    It is a mobile phone provider so I am aware that the the regs are different as it is a service contract and does not come under the CCA.

    Firstly the information provided by the mobile phone company is very conflicting, so the Default itself is very very questionable.

    Second how do they stand with the fact that they have only registered the default (incorrect dates and all) with on CRA ?

    Any information and assistance would be appreciated as this is the one mark against a perfect credit history and for the grand sum of £14.

    Just as a side note the information on all 3 CRA accounts is identical in regards previous address ect

    Could you expand on this? Did the family member ever have a contract with the mobile co? Have they been sent a statement which shows this amount? Is it the default date rather than the amount they are querying?

    Second how do they stand with the fact that they have only registered the default (incorrect dates and all) with on CRA ?
    They are under no obligation to report to any CRAs, let alone all three of them. This line is not going to help you.

      The ICO advises their case officers with the following...

      CRA Defaults - Necessity of recording of defaults with multiple CRAs.

      There is no requirement in the DPA for lenders to report details to all of the Credit Reference Agencies(CRA). There isn’t a requirement in the DPA for them to report any information to the CRA’s.

      However, it won’t be a breach of the DPA for lenders to report the information to the CRA’s as it will be in their legitimate interests and the legitimate interests of other lenders to help them make responsible lending decisions.

      It is up to the lender to decide which CRA or CRA’s they use (if they decide to use one).

        to the Data Controller of the company that placed the default.

          There was a contract that was 24months the contract was ended and the number ported to another provider no further contact from old provider, as one would expect as the contract was finalised and account closed.

          At the start of the year when changing banks theh were declined and told to check CF where a Default had been placed.

          They immeadiatley called the op to challenge this and were told that the quickest solution (to allow for the bank account to be opened) would be to pay the £14 and the Default would be removed.

          It was made clear that although they did not provide any proof of any moneys owing a small sum of £14 would be paid as a gesture of good will without Iability.

          This was agreed, sum paid.
          Bank account opened, This month when trying to secure a mortgage the same default still exists with Call Credit?

          Told by provider when challanged that they did try to remove it however there had been an admin error ????

            A Formal Complaint to the company that made the " Admin Error" address to the Data Controller, you might even get
            a small amount of redress for the embarrassment of being denied credit.

              Update on this situation is that the admin error was that they would never remove a default just process the payment and it would be satified ?????

              Again the information is inconsistant and then esculated up for another wait and more inconsistencies ??????

                This is a very common story with mobile companies.

                e.g. very often there is...

                - A final 'mystery' charge applied at the end of the contract, when you have already been told it is closed with nothing more to pay.

                - They default you with no attempt by them to request payment, or even warn you that it is outstanding and that a default on your credit file will be recorded unless paid promptly.

                - You then discover this months or years later and the company refuses to remove said default.


                You need to make a formal complaint that..

                - They did not tell you that any debt was outstanding on the account.
                - They told you on xxx date the account was settled and closed.
                - You dispute that the £14 was ever owed by yourself.
                - They did not warn you or give you notice that a default would be applied, or any notification allowing you to pay in time to avoid the default being applied.
                - That unless they remove the default you will be taking them to the ombudsman, and reporting the issue of them recording an inaccurate default to the ICO.

                      So had a call from Vodafone this morning saying that they will remove the default and would confirm with 24hrs via email also saying it would take up to 30days for the admin process, obviously I first need the email confirmation but surley its not a 30day process ?????

                          Seems to be a standard coverall reply, it may depend on the company's internal system/timescale for communicating with the CRA's.

                              Is there a similar rep who comes on to answer for EE, i have an almost identical mobile phone default issue for the grand sum of £36 with them with an almost identical circumstances?
