Re: Overdraft default placed 1 year after missed payment

Thanks debt camel! Re the payday loans bit, I was just hoping they would take the defaulted ones off my credit file, I borrowed ££££s from them back in my dark days, which ultimately ended up with me defaulting on the last 1 on each, roll overs and random amounts take from bank accounts. Your link was pretty interesting...thank you!
The reason I am in the back foot with the PPI is the last payments on the loans was September 2009 so only just statue barred! And still getting letters, and I didn't want to reset clocks enquiring about the previous paid off loans, thank you again for the links thou :-)

If a debt is statute barred it still exists, so the lender is within his rights to offset any PPI reclaim against the outstanding loan. They may not, but it's something to be aware of.

Just spoke to Lloyds, the statue bared debt was sold on, so they said they wrote to me at my old address as I had 2 other loans with them (I thought 1!) asking if it had been mis sold already as PPI was paid on both of them, she can see that I had to refinance the loan to get the ppi off for the 3rd, they took all the details and said they are sending the claim form and I should have a decision by 15th feb 😊 so far straight forward!

Re: Overdraft default placed 1 year after missed payment

          Hi!
So quick question...another old statue barred debt, catalogue sold to lowell, they contacted me last year, I disputed it and asked them to prove it, they said last payment on account sept 09 default registered may 2010 (as per credit file) but a mystery payment of £10 was added to the account in May 2010...therefor they said it was not statue barred...no paperwork proof from them and all went quiet...now I get a call from cap quest! The conversation went like this...you made the last payment September 09, it was placed into default may 2010...but I can see you made a payment of £10 in May 2010....ok...so I say last payment you just said was sept 09...he said I read it wrong, I can see you made a payment after the default. Now call me suspicious but I believe lowell added this payment to reset it...is this possible??? Because I'm 99.99999% I didn't do it, ever heard of this happening before?

Scrap that! Just had a look through the forum and found others who have had it done, will ask cap quest to prove it :-)
