  • Paying ccj within 30 days of judgment

    Hi I have a ccj for a disputed phone bill. I sent the court papers back stating I owed 235 which was accepted however received judgment for £275.

    I have contacted the creditor and they agreed for me to settle in for £235 Within the 30 days so the ccj is removed. I have paid the £235 and got conformation that £235 has been received in settlement of the account? My question is will the ccj be removed or should I pay the £275 on the judgment I received as believe the additional £40 was for judgment? Don't want to get any surprises to state I did not settle the full amount? And the ccj to be on my file for 6 years.

    If you received judgement for £275.00 that is how much you pay to satisfy the jusgement and stop it being recorded

    The court set that amount,not the original creditor

    You can get anything else back from the creditor at a later date

      Thanks so even though they have agreed the 235 I should pay the 270 as that is what the court has requested. They did state they would send a stop notice to the cost to stop the ccj. But think I might just pay the extra 40 just to be safe.

      Also as this account was previous showing as default on my credit file and will now be settled will this still drop of my credit file from default date plus 6 years or settlement date plus 6 years?

        Pay the £275.00 and no record of the claim will be recorded on your credit file

        The original default will just drop off after six years as normal from original default date

        DID YOU PAY THE JUDGEMENT DIRECT TO THE CREDITOR OR TO THE COURT?

          If the CCJ was for X X must be paid unless the creditor agrees different

            The " extra " amount will be the court costs which remains payable as part of the judgement.

            A two pronged enquiry to the court manager on the procedure and to the claimant in reference to the settlement unfortunately this situation is often seen when the claimants accepts a " settlement" lower than the judgement order, lack of communication and just plain forgetfulness leads to judgement not being cleared from the public records.

              Thanks all for the above

              I paid the 235 to the creditor.

              Spoke to the court today who said they had not received anything from them to notify them the ccj had been paid.

              I found Mortimers back and spoke someone who said I had £40 outstanding but said they sent a stop notice to the court but this was rejected by the court (surely this would not happen as the court don't care either way they just need to understand is the debt paid or settled?

              After an hour on the phone and 30 no manager is in/ or no one who can email. A manager will call you tomorrow somebody sent me an email with the below.

              "Dear Sir,

              We confirm receipt of £235.00 on 12th October 2015 in full payment of the debt. We confirm that will have contacted the court to inform them that the debt has been paid in full within 28 days of the judgment date.

              We confirm that the account will be closed and you will be notified in writing in due course"

              Would this be enough for me to now disputed this with the court at a later today to ensure the ccj would be lifted? Or is it worthless?

              As today is day 26. Don't want to be naive and land a ccj for 6 years.

              Or should I check with the court tomorrow if they havent received anything pay the 40 to cover myself and then try to get it back of them later?

                Check again certainly! There is a backlog in the court system at present so documents may actually be in the court
                but as yet unprocessed.
