  • Restons - bunch of amateurs!!!

    Just had to post this. I've been arguing with Restons for a few months now due to a debt passed from Apex Finance, threatening court action etc.

    Not going into too much detail but I wrote to Apex several times for paperwork and queries after ending a debt management plan and going it alone. Anyway, I told them as soon as I hear back from them I would resume payments and with no answer at all it was passed to Restons.

    Restons said if I didn't pay the debt off or come to an agreement that would suit them they would be taking me to Court. I said that I would continue the monthly payment I had agreed with Apex but was still awaiting the outcome of my queries and requests. After doing an income and expenditure they said I could afford more than I was offering (the I&E did not include food and petrol as these vary) and continued with the threat to Court.

    I said to them that next year (April) I am going to be in a position to clear my debts completely and would pay £5 per month and come to a settlement agreement then. Answer was no. I asked them why they wanted to take me to Court and they said to get a charge on my property. I said to them that if that's their intent then I would agree to a charge without going to Court. They said no, it has to go to Court (complete rubbish!).

    I have now instructed a solicitor who has written a letter to them reiterating my earlier requests and offers etc. and they wrote back to them and said they needed authority from me to deal with them!! Since when did solicitors have to have authority from a client to deal with someone on their behalf? Utter nonsense. They are "supposed" to be solicitors themselves and would know you don't need authority from a client that has appointed you!

    Anyway it is still ongoing - the offer to pay £5 per month and clear up the total balance (which is only just over £2k so no big amount) next Spring.

    I have a feeling THEY are stalling now because my solicitor has backed them into a corner. Watch this space!!!!!

    You mention Apex Finance Is this Apex Credit management an offshoot of Cabot?

      I don't really know to be honest. Apex were one of the companies the debt was passed to.

        What documents did you request from Apex?

        Instructing a solicitor seems a little like using a sledgehammer to crack a nut and is going to cost you a lot of money although without knowing more details it is impossible to give real opinion

        I would never send an I&E that didn't include food and petrol , they won't look at the detail just the surplus at the bottom

          Apex Credit Management Alias Cabot Reston is the preferred solicitor.
          If Crapbot is behind this it's no surprise there is confusion.

            It isn't costing me as I get free legal advice so I'm making the most of it. They probably don't get many people doing that unless it's a shed load of money involved.

                Sorry I got that wrong - it's Arrow, not Apex, that Restons are acting for.

                Strangely, when I speak to Arrow they say they have now passed on the debt, yet Restons keep telling me they need to take advice from their client (Arrow) before answering my questions!

                  Who are Arrow saying they've passed the debt on to? Could you get then to send you proof of it (in writing)?
                  Debt is like any other trap, easy enough to get into, but hard enough to get out of.

                    Arrows model is I think to own the debt and then pass it to a DCA for collection. I think they used Westcott with me.

                      Arrow are saying it's with Restons and they don't deal with it anymore. Restons are saying they have to take instructions from Arrow!!!!

                      They really don't know what they are talking about. I'm glad I've got a solicitor who does know what she's doing!

                      I've asked Arrow continuously since last October to send me the original documents, agreements, etc. and I refused to pay any more until I got the documents. Because they never ever answered me and I continued to write and chase (and have proof) they considered it a default and passed it to Restons who are now saying I need to sort out this debt.

                      I have given Restons the history of my emails (including proof of the £1 for the said documentation) and they are saying it wasn't received and they have no obligation to send the documentation to me without the payment. My solicitor told them that if they are enforcing court action they will need to produce it in any event. It's a load of nonsense.

                      Anyway my solicitor is onto it and she's not taking any s**t. She offered to do this for me free (I work in a legal environment and we deal with solicitors and I mentioned to her about Restons and she said she hates these bullies and offered to act for me so that is why I'm giving them a run for their money).

                      To be honest, I've got past caring about them, I'm just enjoying the fight now. By the time this battle is over I'll be in a position to pay the debt off (and believe me, it will be an offer of settlement, not the whole amount!)

                        So I take it you have sent a cca request and can prove their receipt. So long as the account is covered by act and Sections 77-79 they are trying to mess with you
                        I'm afraid it makes perfect sense to me that arrow say Reston are dealing but Restons can't make decisions.

                          Arrow Global UK tend to outsource purchased debts to 3rd party debt collection agency for management
                          and collection it's unusually for them to go straight to a solicitors which I think may indicate that it believes
                          they have a more than reasonable chance of recovering the alleged debt.

                            If you haven't done so already send a CCA request to Reston by signed for post. Make a point of emphasising they have 12 + 2 Working days to comply.

                              I have requested it several times. My boss wrote a letter for me too. They are saying they won't supply it to me unless I pay the fee (which I already have to Arrow) and my solicitor said that if they are threatening court action then I shouldn't be paying any such fee anyway as I will need to see the documentation should that happen.

                              They are so nasty though - when I told my solicitor that I'd offered them a charge up until next year when I could come to a settlement, they said no, it HAD to go to Court. What a load of tosh! My solicitor said that if it went to Court and the judge knew you'd offered them outside of the Court what they were taking me to Court for they would not be happy!

                              It's just them saying they have to go to Court to wrack up legal fees to add to it.
