  • How to determine whether CCA hascorrect prescribed terms and hence whether enforcable

    I have just received CCA's from several JD Williams Companies and also Freemans and would like to know what to look for specifically on the agreements to determine whether these are correct/enforceable in court.Can anyone help me please?
    I understand that a signature is not now required due to a change in law.However I am puzzled because on opening an account with any of the JD Williams companies,they make a point of repeatedly sending out credit agreements to sign if the first one is not returned immediately.Why would they do this if there is no legal requirement for a signed credit agreement in court?

    Hi welcome to LB,

    Tick box signatures are the most common way of signing up for catalogue credit now.

    Many of the catalogue companies in the past have used magazine adverts ( send no money now is a common phrase) the form states that on the approval of the first order a credit account will be opened for you.
    Some of these will look to sending a credit agreement as a back up, but as said the opening order acceptance and delivery of goods creates an account.

      I would like to determine whether the prescribed terms are correct and therefore enforceable in the CCA that they have sent me.Do you have any pointers on what I should look for?
