interview under caution not recorded...

Hi all, just a quick qeustion really.

I recently attended an interview under caution with the coucil with regards to possible housing benefit fraud, the interview was recorded on the three CD's and as the interview ended i was given my copy and went on my way.
We tried to listen to the CD the other night and the CD wouldn't work. We were then called by the council and they told us that their copies hadn't recorded either.

What happens in this instance?

Was there an independant witness ? Did you have a lawyer present ? I would leave it if the machinery has failed to that extent then there is no evidence. I expect they will invite you back for another interview under caution . But if you can afford it or get legal I'd talk to a lawyer.

Thank you. I didn't have any independent witness with me no. I didn't know if they could do the interview again because surely with no evidence of the first interview, the person could change what they said?
Mind you it wouldn't be too bad as I was totally unprepared for the first as I've never been in this situation before.
