  • forged loan agreements

I bought a flat 5 years ago and the son wanted to to buy back the flat after a year to keep it in the family, after 4 years I decided I couldn't wait any longer and put the flat up for sale.

The son manages the management company and made the sale difficult from the offset. He eventually lodged unilateral notices with land registry with 2 'loan' agreements which he provided, I had never seen these nor signed them. The notices were removed once I sent the relevant forms, I also reported to the fraud dept of the police but no further action was taken.

The flat eventually sold after a year and I was informed by my solicitor that despite a hold being put on the flat by the buyers solicitor another unilateral notice was put on for £28750 stating this is the amount I 'borrowed' to buy the flat.

I've since reported to the police again who are investigating but are unsure if they can take this further.

Today I have received a solicitor letter asking how I intend on settling the £28750 since selling the flat and if I don't respond then they will issue county court proceedings.

There was nowhere near this much equity in the flat an I had to provide evidence to the mortgage company of the deposit funds for the buy to let mortgage.

I'm being blackmailed to attend court and prove that I didn't borrow this money and yet as far as I know nobody has asked him to prove he gave it to me. The'loan' agreements are simple typed documents which I have only seen duplicates, no witness signatures ( that would be because they're fake).

Any advice please? I'd really appreciate it!!!

    Re: forged loan agreements

Are the solicitors letters from the son or the management company, or the prospective purchasers of the flat ?
