  • Council tax benefit/self employed earnings *** need help***

    Can anyone help me with this, i am self employed and my wife has been ill on and off for a few years,

    my earnings are low and last year my weekly average was £13.50 at the full year accounts stage, i projected to the council that my earnings would be £74.50, per week for the full year, therefore my earning are overstated by £3120 approx, i want the council to review my claim for council tax and housing benefit taking into account actual figures. THIS IMPACTS ME IN A NUMBERS OF WAYS
    1) My earnings are over stated so my benefit payment is understated .
    2) I have council tax arrears that i am clearing bit by bit.

    my issue is that that my earnings are overstated by £60 per week approx for the last lear and the council, will not re-look at this and back date it, yet when my wife won her ESA appeal the benefits were reworked and backdated which meant that we lost just as much as we gained because we had been over paid, so my argument is if we have been overpaid due to a change in circumstances and the claim is reworked, then why are the same principles applied to my self employed earnings when actual figures are available

    would also like to know where i can read up on how these claims are worked out ,

    Do they have a liability order on you, also, forget dealing with whoever your dealing with at the council. track down the name and email of the head of revenues, email him, with eh data and a complaint, complain that the officer has not taken into account your earnings.

    Thata the best way, otherwise you will spend weeks in a usless paperwork battle with them Complain to the head of revenues, that wil sort it

      hi,

      yes we have liability orders on previous year's, THEY HAVE ALSO SENT A £10 COUCIL TAX DEBT TO BAILIFFS , WHICH THEY HAVE APPLIED £100 COSTS TO?

        this is an area i have taken it on my self to take task with councils over. My names george, but i go by the name crazy council, exactly due to looking at how councils handel accounts around liability orders, some questions

        1. What council
        2. whats the details of the liabiliry order they wont change ( dates for, dates of order, etc )

        But it does not change what i say, email it as a complaint to the head of revenue, instruct them to hold actions for 14 day, whilst that consider the actions on your accounts.

        In your complaint you have to acomplain about the liability orders, with detail.

        Untill you complain to that person, it will just get passed around. Due to accounting markers, its not in there interest to change your liability order
