    Hi I was wondering if anyone could offer me some advise with an on going issue I've had with lowell.

    I found out I had a ccj dated jan 2015 from lowell for 1,300 for on O2 account which I believe was fraudulently taken out in my name which I knew nothing about so I contacted lowell and made a complaint stating that they had knowingly sent appears to my previous address to obtain the cjj by default. I have evidence that they knew my current address as I'd had previous correspondence with them ,I had sent them a cca letter back in May 2014 asking for more information about that account to which they sent me a statement which didn't give me anything.

    Anyway today I received a call saying that they are going to remove the ccj as it's clear they made a mistake and will send me a letter to confirm this.

    On the 27th may I decided to send them a sar request as I'm sure they will begin the process of pursuing me again for this debt , I was also going to send them a prove it letter so I am have as much information as I can to make these people go away.
    Is there anything else I should be doing at this point ?

    Very grateful for any input to help me as I've had had to deal with this kind of situation before. Thanks

    Hi,

    A CCA request is not relevant to a mobile phone account which is a " service contract " not a credit agreement.

    A SAR should go the O2 Lowell will have little data other than that passed to them at the time it acquired the debt.

    If Lowell are removing the CCJ *setting aside" wait and see what they say in the promised letter.
