  • Discontinued claim at court

    Please help. I had a credit card with Vanguis in 2008 and defaulted because I lost my job. The debt was passed on to a debt collection agent which was being represented by BW legal. They filed a claim at court since I was refusing to pay and a few days before the hearing they wrote me a letter advising that they were discontinuing the case. So my question is, will the debt show up on my credit file as defaulted and if so what should I do. Secondly since the case has been discontinued can it be passed onto another debt collector or does the discontinuation mean end of the story.

    Hi Gary,

    The fact that a court claim is discontinued does not mean the debt
    no longer exists.
    If debt is showing on credit files now it will remain on file for the rest
    of the 6 year period.

    The debt owner (Lowell would that be??) could sell the debt on, but without
    knowing the reason for their discontinuing the claim it is hard to assess what
    may happen.
