  • HMRC Overpayment

    I have an overpayment of £1000 odd pounds on my Working Tax Credits I have tried to appeal this amount but it was turned down is there anything I can do I basically didnt tell them that I stopped working and this is where the overpayment came from.

    When you say you tried to appeal this amount, what did you do? Mandatory reconsideration? Or did you submit form TC846 found here: http://www.hmrc.gov.uk/forms/tc846.pdf? If you haven't done that, it would be your next step.

    If the overpayment was your fault for not informing them of a change in your circumstances, you will be expected to pay it back. Depending on your circumstances, your tax code may be adjusted or deductions can be made from further tax credits awards or benefits. In theory at least, in reality, HMRC decided to act like a regular creditor with me and passed on the alleged overpayment to a series of DCAs. I disputed the debt with HMRC and notified the DCA at the time, they passed it on to another one, but I've not heard a word for nearly a year now. There's been no tax code adjustments or any deductions so what you read on the government site may not always be what actually happens.

      I appealed regarding the TC846 Form regarding the passing of my uncle from cancer but to be honest I had to have the money feeling down from my uncle getting lung Cancer became Self Employed in Nov 2014. I should have informed them then. You mentioned about changing of Tax code also did you appeal on the TC846 form yourself?. I've sent off a Tax rebate for 2014-2015 and my old TA- Territorial Army Payslips so fingers crossed also i have mentioned to them about financial hardship so they have given me 6 months then they will get back in touch with me yes I supposed that I have got in touch with them earlier but with the terrible loss of my uncle it was a hard time for myself but I got through it. cheers for the Advice. how much did you owe?.

        I submitted the TC846 and they just said they were not going to write it off and then unleashed yet another DCA, that was over 6 months after my submitting the form! Still no statement or breakdown to explain the alleged overpayment. I've been doing self-assessment and there's been no tax code change.

        The alleged overpayment was just over £600 so not enough to attempt bankruptcy proceedings or even threaten them. :grin:

        I've never paid anything towards it and I've not heard from anyone for nearly a year now.
