Cabot - vanquis / Mortimer Clarke

  • Cabot - vanquis / Mortimer Clarke

    Hi
    New to this so any help would be appreciated
    Received a court claim dated 5th may 2015 regarding an old vanquis card debt of £528.16. I would like evidence of this as I was under the impression it was resolved.
    It states an agreement between myself and vanquis was made on or around 04.05.2007 and that the defendant failed to make the minimum payments. There's no reference or account number.
    I followed the advice from here and sent the defence slip back to the court and sent a letter each to Cabot and Mortimer for references and paperwork.
    All I have had back is a letter from Mortimer saying that an extension of 28 days has been agreed and that I should inform the court.
    I would like advice if possible on what to do next and how to inform the court.
    Also what would be my new date with the extra 28 days.

    Did you have a Vanquis card and if so, how did you think it was resolved? Did you pay the outstanding balance? Agree repayments?

    Presumably you sent he CCA request and CPR 31.14 requests.

    That's a standard response from Mortimer Clarke.

    You need to forward the letter to the court.

    If the claim was dated May 5th your defence would have been due on June 7th. With the extra 28 days it should be July 5th. This is based on 33 days (28 + 5 for service) from the date on claim plus a further 28 days, = 61 days from date on claim.
