    Hi there,

    I need a bit of help please.

    I had a loan from Northern Rock back in the early 2000's and sadly I defaulted on this after a couple of years. Eventually they obtained a Charging Order on my property in 2008. The debt was then sold to Marlin Europe V who instructed Mortimer Clarke to chase it.

    I didnt hear much from them and last year we were trying to agree a repayment plan but was unable to. Then I heard nothing until end of last month when they sent me a letter that they were going to apply for an Attachment of Earnings order if I didnt contact them. I also received a letter from the County Court where the Charging Order was obtained to say it has now been passed to my local County Court. No forms or anything have been received from the County Court yet.

    I have written back to the solicitors to advise that I want to get this resolved ASAP and that I am going to complete a Financial Statement and send it to them in the hope we can agree a repayment plan. I really dont want to have an Attachment or Earnings order.

    So, my question is, if the original CCJ expired in 2014 for the Charging Order, can then still chase me for the debt?

    Hi, welcome to LB.

    County Court Judgements do not expire, the " usual" process is County Court Judgment which is not satisfied the creditor then applies for the CO to secure their interest.
    Can you tell me when the judgement was made and the terms of the judgment order?
    Is this still Mortimer Clark acting for Marlin?

    Enforcement of the original CCJ is allowed.

    It may be if any previous arrangements to pay the judgement have failed the creditor will not accept any future
    " offers " of payment unless they are secured as with an AOE, if the order is made your employer cannot refuse to
    comply with it.
