    no it is from 1st entered on CRA file, so the 6 years from the original entry.


    The last payment in 2008 and a default placed 12/10/2009 is out of order and could/should be challenged with Cap ones data controller as Nemises says!

      The default entry will be removed from CRA files 6 years from the default date
      paid or not.

      The account was defaulted and that must be left on file for the balance of the 6 years, there is a BUT to this
      seeing as this has been prolonged to a great degree, you could " ask" for a gesture of goodwill and fairness
      that they remove the data, it's worked before.

        Just to clarify, last payment was 30/12/08 and default date was 26/06/09 which would mean six years is up at the end of this month??

          I have written confirmation from Freds that the account will be closed but haven't had any correspondence under the name of Lowell on the subject. Is it worth my sending them a copy of the Fred's letter and asking for confirmation their end? Provided I get confirmation I could then possibly look into enquiring when the default will be removed from CRA records which to my reckoning should be some time around 26/06/15??

            Lowells and Freds are two 'arms' of the same company ... if Freds have closed the account, then Lowells will have been informed
            As for the default date, did you take @nemesis45's advice and contact cap1 about how long it took for them to report it to the CRAs? If you had a default notice on 26/06/09 then it should have been reported then (instead of 12/10/09)
            Debt is like any other trap, easy enough to get into, but hard enough to get out of.

                Hi Kati, as mentioned in an earlier post a default notice was placed on the account on the 26/06/09 well before I received a signed copy of CCA which finally arrived on 12/10/09.
                I think if I'm going to make a complaint to Cap1 at all it would be for putting a default on an account that they hadn't produced a signed CCA as requested in first letter dated 29/01/09. This might prove to be a useful negotiation tool in getting the default removed from CRA records.

                  The default entry originally made by Capone and id not relative to the non provision of a CCA request, there can only be one default registered on any account and the original default date remains the same even when the debt is sold on.
                  A " Default Notice" is not confirmation that a default has been registered with CRA or applied o the account.

                    Okay thanks Nem!
                    So just to get things straight, since my last post I have checked Equifax and sure enough the account is registered to Lowell who took control of the account July 2014. The default date is showing 26/06/09.
                    Am I right in thinking then that the default should disappear from my file some time around the end of this month?
