  • Hearing this week for judgement to be set aside...

    Hi

    I have previously posted about a CCJ for a debt from 2005, through Lowell/Bryan Carter.

    I have applied to have judgement set aside for a 10 year old debt, statute barred, it is this week and just wondered if I am supposed to submit anything to the court before the day? Bryan Carter have submitted their side as they won't be attending.

    All I can think of really is printing out my credit file to show the account is not on it?

    Bryan Carter have stated that a small payment was made in 2011, just before the 6 years were up (I know I never made this payment), but nothing to evidence it so not sure how I can prove I did not make a payment?

    I've literally no idea what to expect when I go to the court and would appreciate any advice.

    I presume Carter and his client have not provided any proof of the alleged payment?
    it's a common stitch up used by debt purchasers a mystery payment that suddenly comes to light
    when a debt is stated to be SB.

    How much was the alleged payment for £1/£10?

      It's for £9.59, no proof of payment no.

        Very odd payment, and no other detail other than a simple claim that a payment was made?

        You will need to be firm that you have no knowledge of any such payment made by you or any 3rd party acting for you.

        My guess is this may be a refund or chargeback you can suggest this it does not affect the SB status.
