  • Notice Of Discontinuance

I had a Court hearing on 27/02/2015 regarding a CCJ that appeared on my Credit File. Mortimer Clarke was chasing a debt that was statute barred.

The Judge drew up a General Form Of Judgement that ordered Mortimer Clarke to produce The Original Agreement, The Default Notice, Statements Of Accounts. They had till 4pm on the 10/04/2015 to produce these otherwise the claim will be struck out.

This weekend, I recieved a letter from Mortimer Clarke stating that they have been instructed by thier Client (Cabot Financial) to discontinue proceedings. They have enclosed a Notice Of Discontinuance. I spoke to Cabot Financial who told me to wait a week or so as they are yet to recieve the paperwork from Mortimer Clarke. They also stated that I should keep an eye on my Credit File to see if the CCJ comes off.

As i have this notice, shouldnt the CCJ automatically fall off or should I contact someone to get it removed?
