    Hi all,

    I looking for some advice, after trawling the forums for hours I decided to post - here goes!

    I took a secured loan (there is a charge on the LR although not very informative as you would expect, it basically says don't sell the house we are involved - no figures or mention of loan) out with Welcome Finance - I think in 2006. In 2007 I had an accident and couldn't make the payments due to being unable to work, I tried to claim through the insurance I had in place which didn't happen for whatever reason (I think from memory it was something to do with being a sub contractor on price work).

    I got a bit peeved at this and never made another payment nor have I acknowledged the loan since.

    I have been sent letters from various shady debt collectors but never acknowledged them or contacted them. Strangely this has never affected my credit score (probably due to Welcome going bust and the credit reporting net being kept up to).

    The latest company is Cabot Financial though who have instructed Mortimer Clarke Solicitors who in turn have filed a County Court Claim Form.

    My real question is where do I go from here? It has been 8 years then from out of the blue - ACTION!

    The particulars of Claim:

    'By an agreement between Welcome Finance (WLCF) & the defendant on or around 29/05/2007 ("the Agreement") WLCF agreed to loan the Defendant monies under the terms and conditions set out therein. In breach of the Agreement the Defendant did not pay the instalments as they fell due and the Agreement was terminated. The Agreement was assigned to the Claimant. THE CLAIMANT THEREFORE CLAIMS 11881.13'


    The "on or around" bit gets me! I have requested copies of all documentation from Mortimer Clarke and posted back the County Court Claim form to acknowledge the Claim.

    Supposing the documents don't turn up (I suspect they won't) where would I stand?

    SIimilar situation but, as yet no court claim.
    Sounds as if you have done the right thing .
    Someone more knowlagable will be along hopefully.

        You ignored a loan secured on your property?? You are very lucky you still have your home. How long was the term?
