    Hello I'm after some advice

    i have a court date set for the 23rd of this month for a car finance debt I took out in October 2007, the car got written off in the December of that year and the account went into default due to me not paying in the January. I made no contact with the company from that date even though they sent letters after letters to my parents home. I recently received ccj papers from Brian carter solicitors saying they want to take me to court. I sent all the relevant paper work etc claiming this is statue barred etc and also requested a copy of my credit agreement and any relevant documents. They have now got back to me with this paperwork and everything looked as I thought until I noticed they highlighted a payment of £1 in April 2009, I checked online with my bank and there it was £1 payment. I do not know how this payment was made as from that day I made no contact with any company regarding this debt. Is it possible they still had my bank details? My question is am I completely stuck in trying to defend myself in the court, could I not ask how they come to get that £1 payment 16 months later. Any help would be much appreciated

      On your bank statement does it have a method of payment/payee etc ?

      Have you been in contact with any claims management type company ? Did you have a direct debit set up on the account originally to make the finance payments ? any other payments gone out at all ?

        Did you ever send a CCA request? £1 is the fee and sometimes the fee is misused and paid towards the account. Most people send POs to cover the fee and this wouldn't have come out of your bank account but it would if you'd sent a cheque. Otherwise I can't think of any other reason to have made a random £1 payment 18 months after defaulting. :noidea: :confused2:
