  • CCJ / Cabot - Advice Needed

    Help! Have been served with papers for a CCJ in relation to a Black Horse loan although paperwork is from Cabot.

    I was mis sold PPI on this loan so am refuting the balance outstanding - am I ok to dispute on those grounds?

      Hi Beccy, Welcome to the forum. Yes you can use the PPI as part of your defence however there a few other things you might be able to use in the meantime as PPI is actually quite a difficult argument for court - it's good to use for out of court settlement negotiations though.

      1: ACKNOWLEDGE THE CLAIM - you can do this online usually at www.moneyclaim.gov.uk
      You'll need your claim reference and password from the front of the claim form - this will extend the time you have to respond to the claim to 28 days from when you received it

      2: Send A CCA REQUEST to the CLAIMANT ( see here )
      This applies to all credit cards / loans / hire purchase / store cards type debt. It doesn't apply to Mobile Phones / Utilities or Overdrafts. This asks for a copy of the credit agreement you signed and the terms you signed up for. They need to supply this under the Consumer Credit Act 1974 else they cannot enforce(get judgment) on the debt.


      3: Send a CPR request to the CLAIMANT'S SOLICITORS ( see here )

      This applies to everything unless they happen to have supplied you with a bunch of paperwork to back up their claim (v. unlikely)


      Can you give us a bit more info on the black horse laon, approx how much is the claim, when did you take out the loan etc ?
