    Re: Help please!

    Another quick question,
If I defend the claim and loose will I still be able to come to an arrangement or will have to pay everything at once?

      Re: Help please!

To begin with I am not qualified so take my comments with a sense of caution. glad to hear your still together that stops one thought I had.....OK see what the bank comes back with.

When you write the letter ask for copies of the bank statements. As Amethyst has suggested there is a possibility the bank has miskeyed an addition to account as an arrangement. DO Not suggest that in your letter, just ask for copy statements from June 2007 when hubby opened account to say October 2007 as they are the ones you are missing from your records.

if they reply and say they have not got them. go to a branch use their internal phone..... call head office and go through all the options until you can get the LEGAL or SETTLEMENT department. Tell them you want copies of the statements and they will send them to you within a week. I have had lots of dealings with the banks and the department they tell you to call will not help you.... the settlement department will give you all you need. Cause your telling them you need the info to come to an Opinion.

As for the last ? if you defend and lose.... it really depends from my experience on 3 things. 1 your finances. 2. the bank. & 3. The judge.....If you go up in front of Judge BE Very polite......sometimes it does benefit your case.

Thank you all so much for your help!
I will come back as soon as I have any news! Do I need to send the letter to the head office or to the branch that opened the account?

Contact the Financial Ombudsman service they will contact the bank and investigate what has happened they'll contact the bank then send yourself a letter. Then the Bank will contact yourself. You'll have to google FOS I dont have the number to hand sorry. When the customer services agent contacts yourself. Ask for a list of all statements.

                Re: Help please!

I'd forward a copy of the letter to the court informing them of the 28 day extension and the new date for your defence :tinysmile_grin_t:

                  Re: Help please!

Write straight away to the court (can email instead) and attach copy of this, telling the court what your new date is for filing the defence. You just wait then to see what they can provide but watch the dates and as we get near that we'll see what responses you've had.

                              Hope everybody is doing well!
With regards to my post , I have now 5 working days to fill in my defense and I have not received anything from the solicitors. After agreeing the 28 days extension my last day will be the 27th of this month. When do I need to fill in my defense? on the 26th? and what should I write if I still don't receive anything?
                              Many thanks!
